Council of the City of Port Orchard, Washington, called to regular session by Mayor
Leslie J. Weatherill at 7:30 PM at City Hall, 216 Prospect Street. Councilmembers
present: Clauson, Childress, Morrison, Geiger, Powers, Van Zee and Grable. Staff
present: Police Chief Mathews, City Planner Brown, City Engineer Curies, Fire Chief
Snow, Deputy Clerk Hager, City Clerk Parks and City Attorney McCloskey.
Chief Mathews led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda.
David Card, 6010 Wynn Jones Rd E., Port Orchard, expressed concern with City's
nuisance abatement process, specifically the procedure to identify responsible
property owners. Due to mistaken identity, he was subpoenaed into Municipal Court.
Mr. Card requested the City reimburse his attorney fees. Mayor Weatherill placed
this matter into the Finance Committee for review and recommendation.
Ed Recknagle, 198 Tremont Street, requested the fees in Lieu of Assessment be
removed or reduced for his property. Mayor Weatherill placed this matter into the
Water/Sewer Committee for review and recommendation.
On motion by Councilman Grable, seconded by Councilman Geiger, Council approved the
Consent Agenda with item 3g. removed for further discussion (Proposed Ordinance No.
1617 approving the Preliminary Plat of Heron Ridge Subdivision, as submitted by
Jerry Clark):
(a) Minutes of the following Council meetings:
(1) October 10, 1994 regular Council Meeting (revisions on
pages 7 and 8)
(2) October 5, 1994 Special Public Hearing regarding the
Draft Comprehensive Plan meeting
(b) Payment vouchers as follows: Claims Warrant No. 21397-21475 in
the amount of $581,021.35.
(c) Resolution No. 1682 finding Jerry and Barbara Seitz as the
operator, manager or agent of a permanent show or public
amusement center.
(d) Resolution No. 1683 approving the issuance of a Special Use
Permit to R.D. Manning for property located at 1800 Sidney Avenue
to allow the continued use of a 400 sq. ft. portion of the Arbor
Terrace Apartment Complex Recreation Building as a business
office upon completion of the contractor's work.
(e) Resolution No. 1684 repealing Resolution No. 1653 and
establishing regulations and fees related to parking, stopping or
standing in certain areas of the City.

(f} Ordinance No. 1616 amending Port Orchard Zoning Ordinance No.
1469; by amending the area and use maps thereof, reclassifying
2.5 acres of property located in the 1300 block of Lloyd Parkway
to allow a work release facility, City of Port Orchard,
applicant.
Mayor Weatherill opened the 7:35 PM Public Hearing regarding the proposed adoption
of the Ross Creek Management Plan.
City Attorney advised audience, Councilman Childress owns property in the Ross Creek
area. Mr. Childress feels he can consider facts and testimony in an unbias manner
and asked if anyone had any objection to Councilman Childress participating in the
Public Hearing process. No objection was received from the audience.
City Engineer gave a brief history of the proposed Ross Creek Management Plan. The
purpose of this study is to examine and assess the current environmental condition
of Ross Creek and identify best management practices for its long-term enhancement
and preservation. City Engineer Curles recommended this document be used as a guide
for Ross Creek development. The Suquamish Tribe has requested a more regulatory
document.
Tanis Desy, Better Homes and Garden Real Estate agent, stated real estate agents are
looking for specific guidelines for potential buyers.
Mayor Weatherill called for further input either for or against the proposed
adoption of the Ross Creek Management Plan. As no further response was received,
Mayor Weatherill closed the public input portion of the Public Hearing and referred
the matter to Council for their consideration.
On motion by Councilman Geiger, seconded by Councilwoman Powers, Council adopted the
Ross Creek Management Plan to guide the preservation and protection of the Ross
Creek Watershed.
Mayor Weatherill reopened continued Public Hearing relative to consideration of the
Draft Comprehensive Plan. (Continued from October 10, 1994 Council meeting).
City Planner Brown presented the revised Transportation Element and requested the
Council review this element and submit comment at/or before the next public hearing
session.
Mayor Weatherill called for input supporting or in opposition to the Draft
Comprehensive Plan. No response was received and Council continued the Public
Hearing on the Draft Comprehensive Plan to the November 14, 1994 City Council
meeting at 7:45 PM.
City Planner Brown discussed the proposed Code Enforcement Program and highlighted
the necessity to decriminalize portions in the zoning, subdivision and nuisance
abatement ordinances. These ordinances will be placed on the consent agenda

On motion by Councilman Van Zee, seconded by Councilwoman Powers, Council approved
Ordinance No. 1614 which establishes the duties of the Code Enforcement Officer.
On motion by Councilman Van Zee, seconded by Councilwoman Powers, Council adopted
Resolution No. 1679 which designates the responsibility of the code enforcement
personnel.
On motion by Councilman Van Zee, seconded by Councilwoman Powers, Council amended
proposed Ordinance No. 1617 regarding the Preliminary Plat of Heron Ridge
Subdivision, as submitted by Jerry Clark with the following corrections to reflect
Council intent: (1) Condition No. 19 amended to read as follows: The Developer must
construct a crushed rock six foot wide shoulder along the Melcher Street border of
the subdivision from the entrance (eastern access) of Heron Loop to Hill Avenue; (2)

Geuneil appraf4 ' Motion passed with 4 ayes, Councilmembers Clauson, Morrison and
Childress refrained from voting due to a conflict of interest.
On motion by Councilwoman Powers, seconded by Councilman Geiger, Council adopted
Ordinance No. 1617 approving the Preliminary Plat of Heron Ridge Subdivision, as
submitted by Jerry Clark with the correction to Condition No. 19 and the deletion of
Condition No. 23. Motion passed with 4 ayes, Councilmembers Clauson, Morrison and
"hildress refrained from voting due to a conflict of interest.
On motion by Councilwoman Powers, seconded by Councilman Grable, Council approved
Ordinance No. 1618 amending Port Orchard Zoning Ordinance No. 1469; by amending the
area and use maps thereof, reclassifying nine acres of property located along the
200 block of Melcher Avenue, Jerry Clark, applicant. Motion passed with 4 ayes,
Councilmembers Clauson, Morrison and Childress refrained from voting due to a
conflict of interest.
Mayor Weatherill and Council congratulated Councilwoman Powers on her nomination and
receipt of the Port Orchard Chamber of Commerce "Woman of the Year" award.
