12/27/1994 - Regular - MinutesPort Orchard, Washington December 27, 1994 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie Weatherill at 7:30 PM at City Hall, 216 Prospect Street. Councilmembers present: Clauson, Childress, Morrison, Geiger, Powers, Van Zee and Grable. Staff present: City Treasurer Miller, Police Chief Mathews, City Planner Brown, City Engineer Curles, Fire Chief Snow, City Attorney McCluskey and City Clerk Parks. Attorney McCluskey led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. No response was received. On motion by Councilman Grable, seconded by Councilman Van Zee, Council unanimously approved the revised consent agenda as follows: a. Minutes of the December 12, 1994 Council meeting b. Payment vouchers as follows: Claims Warrant No.21732 - 21799 in the amount of $258,286.27. C. Ordinance No. 1625 repealing ordinances as follows to abolish inactive Funds: Ordinance No. 387 (POMC 3.04.010-013 L.I.D. Guarantee Fund), Ordinance No. 553 (POMC 3.04.020-021 Parks Fund), Ordinance No. 888 (POMC 3.04.050 Emergency Employment Act Fund), Ordinance No. 904 (POMC 3.04.060 Federal Shared Revenue), Ordinance No. 954 (POMC 3.04.080 Cumulative Reserve Fund for Street Capital Improvements matching funds, Ordinance No. 991 (POMC 3.04.090 Public Works Employment Act of 1976 Fund), Ordinance No. 1009 (POMC Chapter 3.20 Fire Truck Special Levy Fund and Ambulance Special Levy Fund), Ordinance No. 1021 (POMC Chapter 3.24 Water Main Construction Fund), Ordinance No. 1023 (POMC Chapter 3.28 Water Storage Construction Fund), Ordinance No. 1119 (POMC Chapter 3.40 Joint Sewer Treatment Facilities Fund), and Ordinance No. 1273 to close the State Land Purchase Trust Fund and authorizing transfer of balance of said fund to Water -Sewer Operating Fund. d. Ordinance No. 1626 amending Ordinance No. 1599 by amending the salary schedule for employees of the City of Port Orchard for the year 1994. e. Ordinance No. 1627 amending the budget for the year 1994, ordering appropriation of funds and authorizing budgetary transfer(s). f. Resolution No. 1688 designating the City Shoreline Administrator. g. Resolution No. 1689 designating the City Planner as the Administrative Variance Official. h. Proposed Resolution No. 1690 adopting the Capital Facilities Plan. Mayor Weatheri 11 reopened continued Publ i c Hearing relative to consi derati on of the Ci ty of Port Orchard Draft Comprehensive Plan. (Continued from December 12, 1994 City Council meeting). City Planner Brown distributed the draft Land Use Element of the Draft Comprehensive Plan highlighting various aspects of this element. Mayor Weatherill called for public input on the City's Draft Comprehensive Plan. As December 27, 1994 Page 2 of 2 no response was received, he closed discussion on the Draft Comprehensive Plan and referred the matter to Council for further discussion and consideration. On motion by Councilman Morrison, seconded by Councilwoman Powers, Council authorized City Planner Brown to send the complete Draft Comprehensive Plan to other jurisdictions for a 30 day review and comment period. Councilman Van Zee moved to continue Public Hearing regarding Draft Comprehensive Plan until February 13, 1995 at 7:35 PM, seconded by Councilman Grable and carried. Councilwoman Powers, Chair of Public Property Committee, reported on letter from Department of Natural Resources soliciting the City's interest in participating in the "Tree City, U.S.A. Award Program". After much discussion on award program expectations and budgetary constraints, Councilwoman Powers moved to not pursue joining the "Tree City, U.S.A. Award Program" at this time. Seconded by Councilman Geiger and carried. On motion by Councilman Geiger, seconded by Councilman Morrison Council excused Councilman Childress from January 9 and January 23, 1995 Council meetings. Councilman Clauson extended appreciation and praise to City Treasurer Kristine Miller and her staff for the excellent job they do in maintaining the City's financial records. The 1993 State Audit Report was flawless with no findings, letters or comments. City Treasurer Miller requested clarification of 1995 funding source for the position of Court Probation Monitoring Clerk. The preliminary budget proposal offered two possible funding sources, Criminal Justice Funding or Current Expense Fund -Municipal Court. On motion by Councilman Clauson, seconded by Councilman Morrison, Council designated 1995 budget expenditures for the position of Court Probation Monitoring Clerk to be paid with Criminal Justice funding. William Palmer requested City Council provide a Letter of Water and Sewer Availability for the proposed project known as "Sidney Valley Junction- Preliminary P.U.D. This project is located outside of the City limits in the southeast quadrant of the Sidney Road/Sedgwick Road intersection. Mr. Palmer informed Council members that proponents have submitted a land use zone reclassification application to Kitsap County seeking Business Commercial Zoning to accommodate a 9.9 acre development which will include a 68,000 retail store, gas station and mini-lube service center. On motion by Councilman Clauson, seconded by Councilman Van Zee, Council authorized a letter of conditional willingness to provide Water and Sewer services to the project known as "Sidney Valley Junction - Preliminary P.U.D." (location: 9.9 acres in the southeast quadrant of the Sidney Road/Sedgwick Road intersection). Willingness to provide such water and sewer service to the Sidney Valley Junction PUD project is contingent upon (1) the City's capability to supply demand at time of development with existing city facilities. Any cost to extend, construct or install new facilities to enable service to this PUD must be funded by the developer or proponents and be of no cost to the City; and (2) provided that the project is located within the Urban Growth Boundaries and is consistent with the Growth Management Act.
