1820 - Ordinance - Olney Business Center Phase IINOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held May 29, 2001, ORDINANCE NO. 1820 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING CONDITION NO. 1 OF THE CONDITIONS OF APPROVAL FOR THE REVISED PRELIMINARY PLANNED UNIT DEVELOPMENT OF OLNEY BUSINESS CENTER, PHASE 11, THE PROJECT IS LOCATED ALONG MILE HILL DRIVE BETWEEN OLNEY AVENUE AND PALMER AVENUE. THE APPLICANT IS THE CITY OF PORT ORCHARD. Copies of Ordinance No. 1820 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Thirty days after publication, copies of Ordinance No. 1820 will be provided at a nominal charge. See Attachment ‘“A” for complete legal. WHEREAS, the Preliminary Planned Unit Development (PUD) approved for this site was granted by Kitsap County Resolution No. 282-1982 in August of 1982, and WHEREAS, the Phase I, Final PUD approval was granted in February 1986, and WHEREAS, Kitsap County Resolution No. 192-1989 approved the revised Preliminary PUD for “Olney Business Center Phase II Access”, which imposed 4 conditions. The access conditions were intended to limit traffic entering and exiting the theaters to right only, rather than allowing lefl turns onto Mile Hill Drive and to stop eastbound traftic on Mile Hill Drive from turning lefl into the site, and WHEREAS, in October 1991, City of Port Orchard approved Ordinance No. 1528 relating to and providing for the annexation of this property into the City of Port Orchard, and WHEREAS, the City Council of the City of Port Orchard held a Public Hearing on May 14, 2001 to hear testimony and public input on the requested modification of Condition No 1, of the revised Preliminary PUD for “Olney Business Center Phase I1 Access” to provide that access from Mile Hill Drive shall be right in and right out until othelwise directed by the City Engineer, and WHEREAS, the City Council of the City of Port Orchard concluded that granting this modification would not be detrimental to the health, safety, morals and general welfare of the community. now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: That Condition No. 1 of the Conditions of Approval for the revised Preliminary PUD for “Olney Business Center Phase II Access” is modified to read as follows and the remaining 3 Conditions of Approval shall be lefl unaltered: I Ordinance No. 1820 Page 2 of 2 1. Access from Mile Hill Drive shall be right in and right out until otherwise directed by the City Engineer. A raised island or other appropriate barrier shall be installed, upon approval of the design by the City Engineer, to stop eastbound traffic on Mile Hill Drive from turning left into this access. There shall be no direct access from Mile Hill Drive to Phase 111 or IV of this development except for emergency only connection that may be necessary for fire protection purposes. All other provisions not inconsistent herewith, shall remain in full force and effect. 2. 3. 4.
