ORDINANCE NO. 1821 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1748; BY AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING THE SUBJECT PROPERTY FROM COMMERCIAL TO R8 RESIDENTIAL, FOR THE PURPOSE OF CORRECTING A SCRIVENERS MAPPING ERROR. Tax Account No. 4044-002-004-0002 LEGAL DESCRIPTION: NW %, SW %, Section 26, Township 24, Range 1 E, Nob Hill Addition to Sidney, including Lot 3, except the West 10 feet thereof and except to State Road: Together with Lot 4, except that portion conveyed to City of Port Orchard by Vol. 182 page 292, in Block 2, Nob Hill Addition to Port Orchard; Situate in Kitsap County, Washington. WHEREAS, John and Andrea Hersey, owner of record, has petitioned the city to recognize the mapping error that occurred with the adoption of the Port Orchard Zoning Ordinance Map No. 1748, to Reclassify the subject property from Commercial to R8. (Exhibit "A") and WHEREAS, it was the intent with the adoption of the 1998 Port Orchard Zoning Map Ordinance No. 1748 approval to reflect a Commercial zone designation for only those properties designated as Commercial on the previous map, or as otherwise specifically requested, and WHEREAS, the subject property has been historically used for residential purposes only, and currently contains a single family residence with access from a local access residential street; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES ORDAIN AS FOLLOWS: SECTION 1. THAT the Council of the City of Port Orchard does reclassify property as described herein, from Commercial to R8, and further amends the City's Zoning Map to reflect the change in the zone reclassification to support residential use of this property. SECTION 2. CONCLUSION based upon the testimony of the subject property owner and the information provided herein, the Port Orchard City Council does hereby conclude that a scrivener's error has occurred, and that granting the reclassification would not be detrimental to the health, safety, morals, and general welfare of the community. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared unconstitutional or invalid for any reason, such invalidity shall not affect the validity or effectiveness of the remaining portions of this ordinance.
