April 23, 1990
Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 P.M. Councilmembers
present: Clauson, Childress, Morrison, Geiger, Smith and Grable.
Councilman Powers excused. Staff present: City Attorney
McCluskey, Deputy Clerk Thomas, Police Chief Mathews, City Engineer
Curles, Fire Chief Snow and City Clerk Hower.
Councilman Childress led the audience and Council in the Pledge of
Allegiance. -
On motion by Councilman Grable, seconded by Councilman Morrison,
Council approved the minutes of the April 9, 1990 meeting as
circulated.
Upon the request of Howard Minor, Councilman Morrison moved to
approve the middle parking space on the east side of Frederick
Street be designated as a loading zone between the hours of 8 am to
6 pm, seconded by Councilman Childress and carried.
Elaine Perkowitz representing the Downtown Merchants Association
asked that Bay Street be closed on Sunday, August 5, 1990 between
9:30 am and 4:30 for the Annual Street Fair. Councilman Grable
moved to approve Downtown Merchants Association request to close
Bay Street on August 5, 1990, seconded by Councilman Clauson and
carried.
On motion by Councilman Clauson, seconded by Councilman Geiger,
Council adopted "Centennial Logo" as presented by the Centennial
Committee. This design will be used for Centennial Pins and other
materials to promote Port Orchard.
Ron Boehme requested permission to hold Revive America Torch Run in
the downtown area Saturday, April 28, 1990 prior to Loyalty Day
Parade. Councilman Clauson moved to approve Revive America Torch
Run on April 28 as requested, seconded by Councilman Grable and
carried.
At 7:45 PM Mayor Weatherill opened Public Hearing relevant to an
Application for a Special Use Permit as submitted by Paul and Donna
Buettgenbach to allow an open storage yard at 250 Bethel Avenue.
City Engineer Curles updated Council on Planning Commission
recommendations.
Mayor Weatherill called for input either for or against the
proposed application for a Special Use Permit as submitted by Paul
and Donna Buettgenbach.

Donna Buettgenbach, proponent, concurred with conditions
recommended the Planning Commission.
Dennis Lamphere, representing family property adjacent to 250
Bethel Avenue, questioned the impact this project would have on the
City water system, fish and pollution to Blackjack Creek. Mr.
Lamphere also expressed concern about debris on the site.
Greg Busch, employee for proponent, advised Council they follow all
EPA standards and invited Council to inspect site.
Mayor Weatherill called for additional public input. As no
response was received, Mayor Weatherill closed Public Hearing and
referred matter to Council for consideration.
Councilman Geiger moved to adopt Planning Commission Resolution No.
143-90 (with conditions) as their own and approved issuance of a
Special Use Permit to Paul and Donna Buettgenbach allowing an open
storage yard at 250 Bethel Avenue for a period of five year,
seconded by Councilman Grable.
Councilman Clauson moved to amend motion to have all view block
from Highway 160, seconded by Councilman Morrison.
Council unanimously approved the original motion as amended, to
adopt Planning Commission Resolution No. 143-90 (with conditions)
as their own and approved issuance of a Special Use Permit to Paul
and Donna Buettgenbach allowing an open storage yard at 250 Bethel
Avenue for a period of five year and set additional condition that
all view must be blocked from Highway 160. LEGAL DESCRIPTION:
Section 25, Township 24 North, Range 1 East, Wheelers Addition to
Sidney, Block 4, Lots 3 and 4.
Dave Siburg, PUD #1, discussed Kitsap County Resolution concerning
water rights and its affect on City and County annexations.
On motion by Councilman Clauson, seconded by Councilman Smith,
Council referred matter concerning water rights and its affect on
City and County annexations into the Water/Sewer Committee with
input from the City Attorney to develop a statement to present to
Kitsap County's Public Hearing on May 14, 1990.
Debby Huntington, S.K. Parks and Recreation District spoke to
Council concerning use of the Active Club Building basement, Van
Zee Park and miscellaneous sports equipment for a summer parks and
recreation program for adults and children
On motion by Councilman Clauson, seconded by Councilman Smith,
Council approved the use of the Active Club Building basement, Van
Zee Park and miscellaneous sports equipment for a summer parks and

At 9:00 PM Mayor Weatherill declared a 5 minute recess.
Anita Sanford, 1105 Spokane, requested her water bill be adjusted
for more than the $100.00 allowed because of an undetected water
leak.
On motion by Councilman Clauson, seconded by Councilman Childress,
Council referred Anita Sanford's request for a water bill
adjustment to the Water/Sewer Committee for review.
On motion by Councilman Clauson, seconded by Councilman Childress,
Council accepted Claim for Damages as submitted by Randy Bennett in
the amount of $166.01 for damages incurred to his private vehicle
in City shop parking lot.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council adopted Resolution No. 1535 setting May 29, 1990 at 7:45 PM
as date and time for a Public Hearing on a Petition to vacate a
portion of Alder Lane. LEGAL DESCRIPTION: Situated in Section 34,
Township 24 North, Range 1 East, Kitsap County: The west half of
the City of Port Orchard street called Alder Lane, starting at
Tremont Street for the length of 400 feet northwesterly as measured
on the centerline of Alder Lane, with the north margin being
perpendicular to the centerline.
City Clerk reported on bid opening held April 19, 1990 for the
Morton Street Water Main. Six bids were received with the required
bid bond as follows:

Del Mar Construction 37,198.00
Interstate utilities, Inc. 47,048.00
RT & T Construction 40,720.00
Pape and Sons 37,399.00
R.V and Associates 47,109.77

On motion by Councilman Geiger, seconded by Councilman Clauson,
Council accepted the bidding and awarded the bid for the Morton
Street Water Main to the lowest bidder to Del Mar Construction in
the amount of $37,198.00 contingent upon bid meeting
specifications.
City Clerk read Mayor's Proclamation declaring the week of April
22-28, 1990 as National Volunteer Week. On motion by Councilman
Clauson, seconded by Councilman Grable, Council concurred with
Mayor Weatherill's declaring the week of April 22-28, 1990 as
National Volunteer Week.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council accepted and grant the issuance of Firework Stand Permits
to the following organizations:

Don Morrison, Chairman of Street/Alley Committee, moved to deny
request by Aaron Hallgarth to install a crosswalk on Mitchell
Street on the southwest side of the high school, however the
committee recommended placement of a crosswalk on the north portion
of the high school, seconded and carried.
Councilman Clauson; member of Public Property Committee, moved to
approve lease assignment for Westbay Shopping Center with the name
of the assignee being in the name of the property owner or the
assignment will be void, and the City Clerk will update the amount
of the contract fee based on the rate the City is paying DNR for
the parking lot as set forth in the lease agreement, seconded by
Councilman Grable and carried.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council removed from table Donna Buettgenbach's request to
construct a temporary fence behind Budget Towing (250 Bethel
Avenue) and declared this matter mute.
On motion by Councilman Geiger, seconded by Councilman Morrison,
Council removed from agenda Item #3 - Jeanne Bell concern regarding
downtown parking. Street/Alley Committee is in the process of
studying downtown parking.
On motion by Councilman Childress, seconded by Councilman Grable,
Council approved Budget Towing's request to be placed on rotation
towing for Port Orchard.
On motion by Councilman Clauson, seconded by Councilman Geiger,
Council authorized a meeting with property owners of the Westbay
Shopping Center to discuss proposed property vacation.
Vouchers audited and certified by the auditing officer (City Clerk)
as required by RCW 42.24.080 and those expense reimbursement claims
certified as required by RCW 42.24.090 have been recorded on a
listing and made available to the Council.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council unanimously approved payment of those vouchers as follows:
Claims Warrant No. 13228-13282 in the amount of $71,155.43.
On motion by Councilman Childress, seconded by Councilman Clauson,
Council declared a 1983 Dogde Diplomat (Police Department) as
surplus and authorized its disposal in the best interest of the
City.

On motion by Councilman Clauson, seconded by Councilman Geiger,
Council scheduled a study session on May 9, 1990 at 7:30 PM in City
Hall Council Chambers to review downtown landscaping plans.
On motion by Councilman Clauson, seconded by Councilman Geiger,
Council authorized the placement of a plaque by the Givens PTA on
the Givens Elementary school grounds in honor of past and present
students, under the guidance of the City Engineer.
On motion by Councilman Geiger, seconded by Councilman Clauson,
Council authorized Mayor Weatherill to sign contract with Ace
Paving in the amount of $4,000.00 for paving of Bay Street pathway
from Mitchell Point to Westbay Shopping Center.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council approved deletion of Asst. Supt. of Public Works position
and created a Public Works Foreman position with salary at same
base rate as Asst. Supt of Public Works position. Public Works
Foreman position will a non-exempt position.
