Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Public Right-of-way no Tax Parcel Number Assigned Legal Description: SW % of the SW %of 525, T24N R1 E as further described below WHEREAS, a Petition to Vacate a portion of an unnamed alley within Block 5 Tom Cline's Addition to Sidney between South Street and Central Street legally described above, was received by the City, said petition being signed by all property owners abutting the portion of the street to be vacated; and WHEREAS, in accordance with RCW 35.79.030, a Public Hearing was held Monday, August 27, 2001 at 7:35 PM in the City Council Chambers, City Hall, 216 Prospect Street, Port Orchard, Washington, and WHEREAS, the City Council did vote to approve the Petition to Vacate a portion of Forest Park Street (Berry Street). as submitted by Jerry R. Connell, Bert T. Connell, and Kathleen A. Masterson. and WHEREAS, the petitioners have compensated the City as required by RCW 35.79.030, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES ORDAIN AS FOLLOWS: SECTION 1. That portion of unnamed alley within Block 5 Tom Cline's Addition to Sidney between South Street and Central Street as described as follows is hereby vacated. LEGAL DESCRIPTION: That certain alley, (known as alley #6, also shown on Kitsap County Assessor's map as alley 4031-005). The alley being 16 ft. wide and 600 ft. long. bordered by lots 1-15, block 005 on the west side and lots 16-30 on the east side all within Tom Cline's addition to Sidney as recorded in Val. 1, page 29 of Auditors Book of Plats, filed for record in Kitsap County. Washington. southwest quarter of Section 25, Township 24N Range 1E Ordinance No. 1826 Page 2 of 2 SECTION 2. The Mayor is hereby authorized and directed to execute a quit claim deed to said property, conveying the City's interest therein to Jerry R. Connell. Bert T. Connell, and Kathleen A. Masterson subject to such easements as the City Engineer determines are necessary for City utility purposes. SECTION 3. ordinance, as authorized by state statute, may be published. This ordinance shall be in full force and effect 5 days after publication.
