September 10, 1990
Council of the City of Port Orchard, Washington called to regular
session by Mayor Leslie J. Weatherill at 7:30 PM. Councilmembers
present: Clauson, Childress, Morrison, Geiger, Powers, Smith and
Grable. Staff present: City Attorney McCloskey, Deputy Clerk
Thomas, City Treasurer Miller, Police Chief Mathews, City Engineer
Curles, Fire Marshal Wernet and City Clerk Hower.
Councilman Powers led the audience and Council in the Pledge of
Allegiance.
On motion by Councilman Grable, seconded by Councilman Powers,
Council approved the minutes of the August 27, 1990 regular Council
meeting as distributed.
Lou Stack and Mamie Yee, Port Orchard United Methodist Church,
petitioned for permission to install two directional signs in City
right-of-way for directing new comers to their church.
Mayor Weatherill referred United Methodist Church's request for
directional signs to United Methodist Church to Street/Alley
Committee. Committee is to report back at the September 24, 1990
meeting.
City Clerk Hower read proclamation declaring September 17-23, 1990
as Constitution Week.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council concurred with Mayor Weatherill proclaiming September 17
through 23, 1990 as Constitution Week.
City Clerk reported on bid opening held September 6, 1990 at 4:30
PM for 1990 Street Paving. Two bids were received with the
required bid bond as follows:
Associated Sand & Gravel $50,600.00
Ace Paving $49,132.50
Engineers Estimate $45,800.00
On motion by Councilman Morrison, seconded by Councilman Smith,
Council accepted the bidding and awarded the bid for the 1990
paving to the lowest bidder, Ace Paving, in the amount of
$49,132.50.
Councilman Powers, moved to approve the 1991 Animal Control
Services Agreement, contingent upon City Attorney approval,
seconded by Councilman Smith.

Councilman Clauson moved to table the 1991 Animal Control Services
Agreement to review days and hours of service, seconded by
Councilman Grable and carried.
Sharron King and Kay Morrison, Centennial Committee, distributed
the Port Orchard Centennial event schedule and encouraged Council,
Mayor and all citizens of our City to attend.
Sharron King, Centennial Chairman, requested (1) the use of City
Hall parking lot; (2) the use of the City's Honda K generator; (3)
electricity be installed in parking lot 4; (4) and a recommendation
for the City to install spot lights on the commemorative mural
located on the Port Orchard Library Building.
On motion by Councilman Clauson, seconded by Councilman Powers,
Council approved the use of City Hall parking lot on September 15
by VIPs and vendors during the Port Orchard Centennial Celebration.
On motion by Councilman Clauson, seconded by Councilman Smith,
Council approved the use of the City's Honda K generator by the
Port Orchard Centennial Committee.
On motion by Councilman Morrison, seconded by Councilman Geiger,
Council approved the installation of electrical outlets behind
Peninsula Feed Store on the ticket dispenser for Parking Lot 4.
Howard Minor, 1400 Bay Street, commended City for the Street paving
program and also congratulated the City Engineer and Council for
their continued effort on this project.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council declared as surplus miscellaneous items as listed in
Exhibit "A" and authorized the Public Works Department to dispose
of these items in the best interest of the City.
At 8:00 PM Mayor Weatherill opened Public Hearing to received input
on proposed Zoning Ordinance Amendments relating to Open Storage
Yards.
City Engineer Curles reviewed the proposed changes concerning Open
Storage Yards.
Mayor Weatherill called for input either for or against the
proposed Zoning Ordinance Amendments relating to Open Storage
Yards, as no response was received, Mayor Weatherill closed Public
Hearing and referred matter to Council for consideration.

On motion by Councilman Geiger, seconded by Councilman Clauson,
Council approved Ordinance No. 1492 amending Ordinance No. 1469
relating to Open Storage Yards.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council unanimously approved payment of those vouchers as follows:
Claims Warrant No. 13833-13910 in the amount of $129,385.25 and
August 1990 Payroll in the amount of $158,031.25 (Warrant No.
112173-112375).
Councilman Powers, Chairman Public Property Committee, moved to
allow South Kitsap Parks and Recreation the use of the Active Club
Building basement through November 6, 1990 with further use to be
considered after results of the general election.
Councilman Morrison, Street/Alley Committee Chairman, moved to deny
request by Kitsap County to relocate Law Library on Division
Street, seconded by Council Grable.
Councilman Geiger moved to amend motion to notify the County that
the City will lease property at Kendall and Sidney for the use of
the Law Library, seconded by Councilman Powers and carried.
Council unanimously approved original motion as amended to deny
request by Kitsap County to relocate Law Library on Division
Street, however the City will lease property at Kendall and Sidney
for the use of the Law Library.
Councilman Powers, Public Property Committee Chairman, moved to
approve Real Property Lease Agreement with Fur, Fin and Feathers
Society with the following changes to Section VII "Lessee shall not
sublease, assign or transfer this lease or any interest therein,
without prior written consent of Lessor seconded by
Councilman Geiger and carried.
Councilman Geiger, Chairman Water/Sewer Committee, reviewed
proposed changes to Water/Sewer Ordinance No. 1466 relating to
Water/Sewer hookup fees for Mother -in -Law apartments.
On motion by Councilman Geiger, seconded by Councilman Grable,
Council moved to consider proposed changes to Ordinance No. 1466
relating to Mother -in -Law Apartments at the September 24, 1990
Council meeting.
Councilman Morrison, Street/Alley Committee Chairman, moved to (1)
withdraw City's permission to expand Saturday's Farmers Market out
of Frederick Street in order to keep the eastward fire access open;
(2) direct the Farmer's Market to cease using Frederick Street
after September 15, 1990; (3) have an electrical outlet provided at

the east waterfront parking lot and the Farmer's Market be given
use of that parking lot on Saturdays after September 15, 1990,
seconded by Councilman Grable.
Richard Cooper, Farmer's Market Manager, reported the vendors were
concerned about the Port of Bremerton allowing the market the use
of the Marina Park restroom.
Betty Pilling, vendor Farmer's Market, spoke in favor of the
Farmers Market and encouraged Council to formulate a solution which
will allow growth of the market.
Marlene Massey, Vice President, Farmer's Market, requested a joint
committee meeting with Council and Farmer's Market Committee.
Gene Bake.r, Harbor Master, acknowledged Farmer's Market was an
asset to the City, and recommended the City consult with the Port
of Bremerton concerning the move of the market to the east parking
lot next to the Marina Park.
Arndt Heng, 520 Sweany, suggested Council and Farmer's Market form
a Committee and discuss this issue.
At 9:20 PM Mayor Weatherill called for a 5 minute recess.
Councilman C1auson moved to amend motion to (1) allow Farmer's
Market to occupy expanded area on Frederick Avenue and the
waterfront parking lot as depicted in Exhibit "B" on September 15
only; and (2) establish an annual permit for the Farmer's Market,
seconded by Councilman Powers and carried.
Council unanimously approved amended motion to (1) to allow
Farmer's Market to utilize Frederick Avenue and a specific portion
of the Waterfront parking lot (Exhibit "B"); (2) direct the
Farmer's Market to cease using Frederick Street after September 15,
1990; (3) have an electrical outlet provided at the east waterfront
parking lot and the Farmer's market be given use of that parking
lot on Saturdays after September 15, 1990; (4) establish an annual
permit for the Farmer's Market.
On motion by Councilman Clauson, seconded by Councilman Childress,
Council excused Councilman Morrison from the September 24, 1990
Council meeting allowing him to attend an emergency preparedness
course in Maryland.
On motion by Councilman Geiger, seconded by Councilman Morrison,
Council authorized the Mayor to sign Short Plat Application for the
City's Old Clifton Road property.

On motion by Councilman Clauson, seconded by Councilman Childress,
Council authorized Chief Mathews to purchase an additional police
vehicle from funds derived from the Criminal, Law and Justice
monies.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council authorized Chief Mathews and the Port Orchard Police
Department to participate in the validation process of a Police
Civil Service Test created by Wollock & Associates. Chief Mathews
is also empowered to sign agreement guaranteeing confidentiality.
On motion by Councilman Morrison, seconded by Councilman Powers,
Council authorized the City Engineer to (1) establish a fuel
account with Wilkins Oil; (2) fill all existing City underground
fuel tanks; (3) and if necessary modify two pump stations to
increase the fuel storage capacity.
On motion by Councilman Clauson, seconded by Councilman Grable,
Council authorized the Mayor to sign a Coastal Zone Management
Contract for the DeKalb Street Pedestrian Pier.
