ORDINANCE NO. 1837 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO. 1634; BY AMENDING THE COMPREHENSIVE PLAN MAP FOR A PARCEL ADJACENT TO THE WEST SIDE OF OLNEY AVENUE APPROXIMATELY 660 FT. NORTH OF THE INTERSECTION OF MILE HILL DRIVE. Copies of Ordinance No. 1837 are available for review at the ofice of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Legal Description: Portion of the NE1/4 of the SE % of the SE1/4, Section 25, Township 24 North, Range 1 East, W.M., SEE AlTACHMENT "C FOR COMPLETE LEGAL. WHEREAS, the City Council of the City of Port Orchard has initiated a Comprehensive Plan Map Amendment, CA-08-01, requesting redesignation of a portion of the property described herein, from "Commercial". to "High Density Residential" to be reflected upon the current Comprehensive Plan Map, and all legal requirements have been performed; and WHEREAS, the subject property has been mapped with a split designation of "Commercial" WHEREAS, State Law RCW 36.70A.130 dictates that cities shall at least every five years and "High Density Residential", creating a hardship for fulfilling the goals of the Comprehensive Plan: take action to review and, if needed, revise its Comprehensive Plan; and WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies, and procedures of the Growth Management Act; and WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard their findings and conclusions as stated in Resolution 322-01, that the Comprehensive Plan Map be amended for the reasons stated therein; WHEREAS, the proposed Comprehensive Plan Map Amendment CA-08-01 is found to be consistent with the goals of the community, adopted Comprehensive Plan, and general requirements of the Growth Management Act (RCW 36.70A); now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: That the City Council does hereby adopt Planning Commission Resolution No 322-01 Attachment "A". with findings and conclusion, as it's own and does hereby designate the southern (approximate 180 ft.) of the subject property on the Comprehensive Plan Map as "High Density Residential" as illustrated on Attachment "E. LOCATED ADJACENT TO THE NORTH PROPERTY LINE OF THE ALBERTSON'S SHOPPING CENTER LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF OLNEY ROAD AND MILE HILL DRIVE. Comprehensive Plan, and the community, CONCLUSION: Based upon the facts. testimony, and the materials presented at the Meeting. we therefore conclude that the Comprehensive Plan Amendment, CA-08-01. is consistent with the health, safety, and welfare of the City of Port Orchard.
