AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
VACATING A PORTION OF FOREST PARK STREET (Berry Street), AS
PETITIONED BY RON AND SHAWN HUTCHINSON.
Copies of Ordinance No. 1800 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1800 will be
provided at a nominal charge.

AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
VACATING A PORTION OF FOREST PARK STREET (Berry Street), AS
PETITIONED BY RON AND SHAWN HUTCHINSON.
Public Right-of-way No Tax Parcel Number Assigned.

WHEREAS, a Petition to Vacate a portion of Forest Park Street (Berry Street), legally described
below, was received by the City, said petition being signed by all properly owners abutting the portion of the street to be
vacated; and
WHEREAS, in accordance with RCW 35.79.030, a Public Hearing was held Monday, August 28,
2000 at 7:35 PM in the City Council Chambers, City Hall, 216 Prospect Street, Pori Orchard, Washington, and
WHEREAS, the petition submitted by Ron Hutchinson and Shawn Hutchinson included a notarized
statement signed by Dorothy Culley and Daniel Culley acknowledging their right to purchase to the centerline if this
Petition to Vacate is approved by the City Council and furlher declared they elect to waive their right to purchase subject
properly to Ron and Shawn Hutchinson. and
WHEREAS, the City Council did vote to approve the Petition to Vacate a portion of Forest Park Street
(Berry Street), as submitted by Ron Hutchinson and Shawn Hutchinson. and
WHEREAS, the petitioners have compensated the City as required by RCW 35.79.030, now
therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES ORDAIN AS FOLLOWS
SECTION 1. That portion of Forest Park Street (Berry Street), as described in Attachment "A"
attached hereto and by reference incorporated herein is hereby vacated.
SECTION 2. The Mayor is hereby authorized and directed to execute a quit claim deed to said
properly. conveying the City's interest therein to Ron Hutchinson and Shawn Hutchinson. subject to such easements as
the City Engineer determines are necessary for City utility purposes.
SECTION 3. This ordinance shall be in full force and effect 5 days after publication. A summary of
this ordinance, as authorized by state statute, may be published.
