11/22/1982 - Regular - MinutesN Council of the City of Port Orchard, session by Mayor Paul D. Powers, Jr. Caldwell, Geiger, Miller, Grosso and Riehl, Police Chief Trotter, Engineer Councilman Childress excused. Port Orchard, Washington November 22, 1982 Washington called to regular Councilmcmbers present: Wilson, Clark. Also present: Attorney Curles and Fire Chief Snow. Mayor Powers led the Council and Audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the November 8, 1982 meeting as circulated. Rob Stuvland presented additional data on the Awareness Express Program and thanked the Council for their consideration. On motion by Councilman Caldwell, seconded and carried, Council moved to deny request submitted by Virginia King for a compromise in the compensation due on property which was subject of a Public Hearing held January 12, 1982 relative to a petition requesting Vacation of a portion of Guthrie Street (Flower Street to Port Orchard Blvd). On motion by Councilman Miller, to not extend support relative recommend overturning the Boldt seconded and carried, Council moved to proposed resolution which would Decision'. Mayor Powers opened Public Hearing relative to application for Zone Reclassification as submitted by David Loftus for his property located on the Southeast corner of Sidney and Granat Streets. (260 Granat). Deputy Clerk read Planning Commission Resolution No. 022-82 setting forth Findings of Fact and Planning Commission's recommendation to City Council. Mayor Powers called for public input at this time. (no response) After discussion of matter Councilman Caldwell moved, seconded and carried, to deny application for Zone Reclassification from Residential Low to Residential High as submitted by David Loftus for property located on the Southeast corner of Sidney and Grant Streets. Motion to deny is based on fact that proponent/owner obtained a building permit for a single-family dwelling and proceeded to construct a duplex with full knowledge that existing zoning did not allow a duplex on this site. After building was substantially completed, he then initiated an application for zone reclassification. Mayor declared Public Hearing closed and ajourned. On motion. by Councilman Grosso, seconded and carried, Council authorized City Treasurer to issue warrant in amount of $33,641.87 to Del Mar Construction on December 3, 1982 when funds become available. On motion by Councilman Caldwell, seconded and carried, Council approved Ordinance No. 1219 repealing Ordinance No. 932 (Chapter 3.12 of the Port Orchard Municipal Code) and creating a fund for use by this governmental unit when acting in the capacity of a trustee or agent. On motion by Councilman Caldwell, seconded and carried, Council set date of December 13, 1982 as date of hearing relative to application for Special Use Permit as submitted by Robert & Claudette Schiaefli Approved of Special Use Permit would allow a law office at 623 Dwight. On motion by Councilman Clark, seconded and carried, Council approved Ordinance No. 1220 relating to its Waterworks Utility, specifying and adopting a system or plan of additions to and betterments and extensions of the waterworks utility of the City, including the sewerage system as a part thereof; declaring the estimated cost thereof as near as may be; authorizing the issuance and sale of water and sewer revenue bonds in the principal sum of approximately $7,800,000 to provide a part of the funds to carry out such system or plan; creating a special construction fund to be known and designated as the "Wastewater Facility Improvement Construction Fund;" and authorizing the .issuance of interest bearing warrants drawn upon such special construction fund pending the sale of revenue bonds, or, in lieu thereof, short term obligations. Councilman Geiger reported tenant at 708 Kitsap spoke with him relative to Water/Sewer service at 708-708z Kitsap Street. There are two units with only one unit having been occupied for over one year, tenant would like to have service charge removed for unoccupied unit. Mayor referred matter to Water/Sewer Committee for recommendation. on motion by Councilman Geiger, seconded and carried, Council approved payment of the bills (Voucher No. 01123 - 01156) in the amount of $20,563.82. Mayor Powers declared recess with meeting to reconvene at 9:00 P.M. Councilman Geiger outlined proposed 1983 budget revisions. Department heads and Councilmembers discussed matters relative to their departments and committees. on motion by Councilman Caldwell, seconded and carried, Council set date of Budget Study Session for November 29, 1982 at 7:30 P.M. and date of Budget Hearing for December 6, 1982 at 7.30 R.M. Meeting adjourned at 10:20. P.M.
