10/08/1979 - Regular - MinutesPort Orchard, Washington October B, 1979 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul D. Powers, Jr. Council members present: Wilson, Caldwell, Geiger, Miller, Grosso and Clark. Also present: Attorney Riehl, Engineer Kane, Police Chief Mares and Fire Chief Weatherill Mayor Powers led the Council and audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the September 24, 1979 meeting as circulated. LeAnn Landon, representing the Totem Girl Scout Council, approached Council to appeal the $25.00 cleaning deposit required of each group using the Active Club Building, 1027 Tacoma Street, Ms. Landon stated each troop using the facilities has very little or nothing in their treasury and a $25.00 deposit would create a finance problem for them. Mayor Powers and Council members explained that the cleaning deposit was not meant to impose a hardship on any group and one $25.00 deposit could cover all Girl Scout oriented groups (one deposit from a parent organization would cover all groups within that organization, i.e. Boy Scouts, Campfire, Girl Scouts, etc.) using the facilities of the Port Orchard Active Club Building. The possibility of the City drawing up a Damage Agreement to be signed by the City and groups using the Active Club Building was discussed and referred to the Parks Committee. Gary Chrey, Attorney representing Buck Gehring, addressed complaint filed with the City by Mr. and Mrs. Ted Zink. Mr. Chrey stated he has discussed the matter with Mr. and Mrs. Zink and has worked out an alternative location for the ingress/egress onto Mitchell from Mr. Gehring's development which is satisfactory to both parties. Mayor Powers informed Mr. Chrey the City has received no request for this proposed alternative location of an access road to the Gehring development from Mitchell, therefore, the Council can not approve nor disapprove this matter. Councilman Caldwell reported on meeting held October 3, 1979 relative to the Port Orchard By -Pass Project. On motion by Councilman Caldwell, seconded and carried, Council authorized Mayor to sign prospectus application to the Department of Transportation for Federal Aid Safety Program funds for the purpose of widening Blackjack Creek Bridge and installing an 8--phase traffic control system located at Sidney and Bay Streets. Councilman Caldwell informed Council that a drainage system has been installed on Perry Avenue to handle surface water runoff from the apartments on the west side of Farragut Avenue that previously ran onto the street. Perry Avenue is ready to be opened to one -lane traffic. Councilman Caldwell moved to authorize City Engineer to contract with an engineering consultant relative to designing a bulkhead for Perry Avenue, seconded. After much discussion, Councilman Caldwell move to table motion to authorize City Engineer to contract with an engineering consultant to design a bulkhead for Perry Avenue, until October 22, 1979 meeting. Seconded and carried. Councilman Wilson reported on a damaged junction box at the Little League Field and stated that anyone sticking their hand into this box could be severely shocked. On motion by Councilman Wilson, seconded and carried, Council moved that the City repair damaged junction box at Little League Field and bill the Little League Association or have them repair it immediately. Power is to be cut off from affected pole housing junction box to avoid injury to anyone. Councilman Wilson informed Council of extensive vandalism which has been occuring to City property. Councilman Grosso, Police, Fire Orchard Reserve Police Officers service to the City. & Safety Committee reports Port have given 1900 hours of free Mayor Powers and Council extended a vote of thanks and appreciation to the Port Orchard Reserve Officers and Kitsap County Deputy Officers who donated many hours constructing the Firing Range which is now in service. Councilman Caldwell Moved that Council approve Ordinance No. 1111 to amend Chapter 15.12 of the City of Port Orchard Municipal Code by establishing a Bureau of Fire Prevention defining the duties therein. Seconded and carried, with five ayes and one no. Councilman Geiger voting no. Clerk presented claim for damages against the City of Port Orchard filed by Penny Ecklund on behalf of her minor son, Matthew Aaron Haynes in the amount of at least four million dollars ($4,000,000.00). for injuries incurred during a car -pedestrian accident on June 4, 1979. On motion by Councilman Wilson, seconded and carried, Council moved to reject claim submitted by Penny Ecklund on behalf of her minor son, Matthew Aaron Haynes in the sum of at least four million dollars ($4,000,000.00) for injuries sustained in a car -pedestrian accident June 4, 1979 at approximately 117 Goldenrod Road, Port Orchard, and turn claim over to City's insurance carrier for investigation. On motion by Councilman Geiger, seconded and carried, Council created a new employee position of Shop Foreman in charge of mechanical duties to be effective payroll period beginning October 21, 1979 at a rate of $8.16 per hour. On motion by Councilman Grosso, seconded and carried, Council instructed City Engineer to install surplus park benches within the City at locations where the public would most benefit from them. On motion by Councilman Geiger, seconded and carried, Council approved payment of the bills (Vouchers No. 6134 - 6225) in the amount of $43,456.26 and the September payroll in the amount of $59,616.40.
