Council of the City of Port Orchard, Washington called to regular session
by Mayor Paul D. Powers, Jr. Council members present: Eugene Caldwell,
Lee Caldwell, Wilson, Geiger and Miller. Also present: Attorney Riehl,
Engineer Knobbs, Assistant Engineer Kane, Fire Chief Weatherill and
.Police Chief Mares. Councilman Clark excused.
Mayor Powers led the audience in the Pledge of Allegiance.
On motion by Councilman Lee Caldwell, seconded and carried, Council
approved the minutes of the April 24, 1979 meeting as circulated.
1979 Little Britches Royalty Court invited Mayor, Council members and
citizens of Port Orchard to attend the 1979 Kitsap County Little Britches
Rodeo. Members of the Royalty Court described events to take place
during the Rodeo.
Marvin Coe, Downtown Merchants Assn. spoke to Council concerning their
plans to "Paint the Town" on May 20, 1979. He requested permission to
have traffic diverted from Bay Street during this event.
On motion by Councilman Lee Caldwell, seconded and carried, Council
approved the closure of Bay Street from Orchard Avenue to_.Harrison
Avenue on May 20 during "Paint the Town" event.
Mrs. Ives, representing Tops #231, approached Council requesting a
reduction in rent for their use of the Active Club Building. Matter
referred to Parks Committee for recommendation to be made at May 29,
1979 meeting.
Helen Robinson, Senior Citizen's, approached Council concerning their
request for use of the Active Club Building at no charge. Matter
referred to Parks Committee with recommendation to be made at May 29,
1979 meeting. Senior Citizens to be notified by mail of Council decision.
Jerry Grosso questioned Council at to the low water pressure on Mitchell
Avenue. Mayor instructed Public Works Department to investigate matter.
Robert Gehring requested Council permission to obtain domestic water for
his development on SR 160 from Annapolis Water District. Matter referred
to Water -Sewer Committee for recommendation.
Mayor Powers declared Public Hearing open relevant to Application for
Annexation as submitted by George and Sharlene M. Oakley .for their
property which is contiguous to the City limits of the City of Port
Orchard.
Clerk informed Council that the Kitsap County Boundary Review Board has
approved this proposed annexation.
On motion by Councilman Eugene Caldwell, seconded and carried, Council
approved Ordinance No. 1095, an Ordinance relating to and providing for
the annexation of territory to the City of Fort Orchard for property
owned by George and Sharlene Oakley described as follows:
Tract 1, Fort Orchard Bay Water Front Tracts, as per plat recorded
in Volume 4 of Plats, page 75, records of Kitsap County;
EXCEPT portion condemned by the State of Washington for State
Highway No. 14;
TOGETHER WITH that portion of the first class tide lands as shown
on the "map of the shore and tide lands of Sidney" on file in the
office of the auditor of said county, adjacent of said Tract 1,
Port Orchard Bay Water Front Tracts;
SUBJECT TO: Exceptions, and reservations contained in deed from.
the State of Washington for first class tide lances, recorded December
24, 1920, under Auditor's File No. 111734.
Legal Description continued:
Tract 2 and East half of Tract 3, Port Orchard Bay Water Front
Tracts, according to plat recorded in Volume 4 of Plats, page 75
in Kitsap County, Washington. TOGETHER WITH any uplands and second
class tide lands fronting same, and EXCEPT State Highway No. 14.
SUBJECT TO: Exceptions and reservations contained in deed as recorded
under Auditor's File No. 82876, Rights of Navigation as in Wilbur
vs. Gallagher 77 Washington Decision 2nd, page 307; and
All property lying between the East line of Tract 1 and the West
line of Sherman Avenue (West Boundary of the City of Port Orchard)
including tidelands and EXCEPT State Highway No. 14.
Mayor declared recess with meeting to reconvene at 9:00 P.M.
Engineer Knobbs reported to Council that the western margin of
Rockwell is the 300' mark from the property owned by Deal Enter-
prises who have submitted an application for rezone.
Clerk read letter from Maxine Doyle requesting a refund or renewal
of a building permit issued to her in July 1876. Council stated no
refund or renewal is to be issued as the..Uhiform Building Code, adopted by the:
City of Port Orchard states that if no action has taken place after
a period of one year a building permit becomes null and void.
Clerk read letter from Carol I. Belas requesting the City of Port
Orchard provide special parking for the employees of the Library
located in Port Orchard. Council stated they can not provide free
parking for any select group with the exception of providing park-
ing for the handicapped.
On motion by Councilman Lee Caldwell, seconded and carried, Council
approved Resolution No. 1212, relative to the City of Port Orchard
establishing overhead rates.
Councilman Geiger moved to approve Ordinance No. 1096, an ordinance
establishing license fees for carnivals and circuses. Seconded.
Councilman Wilson moved to table proposed Ordinance No. 1096 to
allow Attorney an opportunity to study and recommend proper wording.
Seconded and carried.
Clerk read proposed ordinance relative to the City of Port Orchard
establishing a new title section in the Port Orchard Municipal Code
(Health, Welfare and Safety), Title 18 and adopting regulations
and procedures for flood damage protection by the creation of a
Flood Plain Plan. Council requested matter be carried over to
the regular Council meeting, June 11, 1979, to allow an opportunity
to study this proposed ordinance.
Mayor Powers announced that due to May 28, 1979 being a _legal holiday
the next regular Council meeting will be May 29, 1979,
Mayor Powers opened the Federal Shared Revenue Proposed Use Hearing
and requested public input at this time. Six interested citizens
spoke and the following persons gave input.
1. Linda Rack, 4-H Council, suggested Federal Shared Revenue
monies could be used to renovate Room 1 of the Active Club
Building to improve the accoustics and the possibility that
portable partitions could be purchased for this purpose.
2. Linda Adkins suggested the City sponsor community performing
arts, ie. theatre, opera or dance reviews.
3. Police Chief Mares submitted list of proposed use of monies
for the Police Department.
4. Fire Chief Weatherill submitted list of proposed uses for Fire
Department.
5. Engineer Knobbs submitted list of proposed uses for Public
Works Department.
Mayor Powers informed Council there will be a study session
relative to Federal Shared Revenue Budget for 1979, May 24, 1979
at 8.00 P.M. in Council Chambers, City Hall.
On motion by Councilman Geiger, seconded and carried, Council
authorized Clerk to obtain official appraisal of property located
in the southwest corner of Tremont Street and Sidney Road.
Councilman Eugene Caldwell abstained from matter due to conflict
of interest.
On motion by Councilman Lee Caldwell, seconded and carried,
Council approved payment of the bills (Vouchers 45730--#5824)
in the amount of $67,623.46 and the April, payroll in: the amount
of $50,210.76, {'Vouchers 18842 - #8944).
