July 23, 1979
Council of the City of Port Orchard, Washington called to regular
session by Mayor Pro-tem Geiger. Council members present:
Caldwell, Wilson, Miller, Grosso and Clark. Mayor Powers excused.
Also present: Attorney Riehl, Engineer Knobbs, Assistant Engineer
Kane, Police Chief Mares and Fire Chief Weatherill.
Mayor Pro-tem Geiger led the audience in the Pledge of Allegiance.
On motion by Councilman Caldwell, seconded and carried, Council
approved minutes of the July 9, 1979 meeting as circulated.
Chris Smith, representative of the Port Orchard Farmers Market
outlined the user fees charged participants of the Farmers Market.
Mr. Smith explained the fees are not a fee for rent of street space,
they are a user fee to cover insurance, advertising and misc.
expenses such as cleanup.
On motion by Counciiman. Clark, seconded and carried, Council moved
to allow the Farmers Market to continue using City right-of-way
contigent upon the Farmers Market, Inc. obtaining adequate insurance
and a Hold Harmless Agreement naming the City of Port Orchard as
additional insured.
Paul Liao and S. S. Lin, representatives of Kramer, Chin & Mayo
presented Council with Consultants Offer and Acceptance Agreement
(Professional Services Agreement P.D. #974-0/79-151) relative to the
Wastewater Facilities Improvement -Step II_to be located at Retsil.
On motion by Councilman Clark, seconded and carried, Council approved
Mayor Pro-tem Geiger to sign Kramer, Chin & Mayo's Professional
Services Agreement P.D. #974-0/79-151 relative to Wastewater
Facilities Improvement -Step II.
Mayor Pro-tem Geiger opened Public Hearing relative to Application
for Zone Reclassification as submitted by Gerald Schlie, attorney
representing Steven House. The property is located on the South
east corner of the intersection of Farragut Avenue Forth and
Stockton Street and is presently zoned Residential High. A 12-
unit apartment exists on lots 3, 4, 5 & 6 which does not conform
with the present zone classification. Lots 2, 7, 8 & 9 are not
developed.
Councilman Caldwell moved to approve the Zone Resclassification as
requested by Gerald Schlie, attorney representing Steven House
owner of record, for a parcel of land on the Southeast corner of
the intersection of Farragut Avenue North and Stockton Street,
contigent upon applicant complying with conditions of approval as
forwarded to Council from the Planning Commission. The rezone
request is from Residential High to Multiple Family 20. LEGAL
DESCRIPTION: Lot 2, 3, 4, 5, 6, 7, 8 and 9, Block 11, Annapolis
as per Plat recorded in Volume 1 of Plats, pages 64 and 65,
records of Kitsap County. Seconded.
Councilman Miller moved to amend motion to state no existing view
of Sinclair Inlet enjoyed by neighboring citizens will be obstructed
by 'Uhis development. Seconded and carried.
Amended origina-1 notion to approve zone reclassification request
submitted by Gerald Schlie, attorney representing Steven House,
carried.
Mayor Pro-tem Geiger read proclamation proposing Sunday,
July 29, 1979, as Maynard Lundberg Appreciation Day.
On motion by Councilman Caldwell, seconded and carried, Council
moved to adopt and publish Proclamation setting July 29, 1979,
as Maynard Lundberg Appreciation Day and call upon all our
citizens to attend this event and join in the festivities at
South Kitsap Gymnasium, July 29, 1979, 2:00 P.M.
Fire Chief Weatherill requested Council permission to send two
men to the Firefighters Conference to be held August 22-24, 1979
in Olympia, Washington.
On motion by Councilman Wilson, seconded and carried, Council
authorized two firemen to attend the Firefighters Conference at
the Tyee Motor Inn, Olympia, Washington, August 22-24, 1979.
Expense to the City will be approximately $311.50.
Fire Chief Weatherill announced the Fire Department is tentatively
planning a practice burn on a house located at 118 Mitchell Avenue,
August 12, 1979.
On motion by Councilman Caldwell, seconded and carried, Council
moved to adopt the Revised Six Year Road Plan as presented by the
Engineering Department.
As requested by Council at the July 9, 1979 meeting, Engineer
Knobbs reported on status of Special Use Permit issued to Jack Cyr
on April 24, 1978. Mr. Cyr had requested he be allowed to utilize
his property located at 712 Cline Avenue as a law office and real
estate office. A Special Use Permit is effective for 180 days and
during this time the property must be utilitzed for the purpose
which the Special Use Permit was issued, or become null and void.
Mr. Cyr has not established a law office or real estate office at
712 Cline, nor has he requested an extension, therefore, the Special
Use Permit is null and void.
Attorney Riehl reported on meeting with attorney's relative to
Perry Avenue, it is their consensus of opinion that the matter of
when to open Perry Avenue to through traffic is an administrative,
and not a legal decision.
On motion by Councilman Clark, seconded and carried, Council moved
to grant the Street/Alley Committee power to instruct Engineer to
employ an outside consulting engineer relative to Perry Avenue, if
after Committee and engineering staff investigation, it is deemed
necessary to obtain additional advice. Permission is also granted
to open Perry Avenue if engineering staff feels it is safe.
Mayor Pro-tem Geiger appointed Councilman Grosso to the Parks
Committee subject to Mayor Power's approval.
On motion by Councilman Clark, seconded and carried, Council set
August 13, 1979, as date of Federal Shared Revenue Budget Hearing
Council will hold a study session July 25, 1979 at 8:10 P.M.
relative to creating a proposed budget for the Federal Shared
Revenue Budget Hearing.
Councilman Miller requested letter be send to Kitsap County
Commissioners to request that illumination lighting be installed
at the intersection of Sedgwick Road and Sidney Avenue.
0n motion by Councilman Clark, seconded and carried, Council
increased sewer rates for the Kitsap County Courthouse and local
schools to reflect rate as follows: Effective September 1, 1979-
30� per person per month; January 1, 1980-35� per person per month.
Councilman Clark read letter from Mr. Curtis King describing
deteriorated condition of City of Port Orchard Ross Creek Pumping
Station, requesting he be allowed to demolish this building for
lumber salvage.
On motion by Councilman Clark, seconded and carried, Council
declared Ross Creek Pumping Station salvage.
On motion by Councilman Clark, seconded and carried, Council
chanted permission to Mr, Curtis King to demolish Ross Creek
Pumping Station building for salvage materials.
