08/13/1979 - Regular - MinutesPort Orchard, Washington August 13, 1979 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul 0. Powers, Jr. Council members present: Wilson, Caldwell, Geiger, Miller, Grosso and Clark. Also present: Attorney Riehl, Engineer Knobbs, Assistant Engineer Kane, Police Chief Mares. Fire Chief Weatherill excused. Mayor Powers led the audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved minutes of the July 23, 1979 meeting as circulated. Kitsap County Fair Royalty Court presented Mayor Powers with a western style hat and invited the Mayor, Councilmen and all citizens of Port Orchard to the 1979 Kitsap County Fair and Rodeo to be held August 22 through 26, 1979. Toby Gustafson and John Kleinbach, representatives of the Kitsap Regional Library, Port Orchard Branch, approached Council with statistics showing growth in population and increased circulation of library materials. Mr. Gustafson requested Council consider enlarging present facilities or relocating the library. On request of Building Inspector, Gene Asa, Ridgemont Terrace and Jim Kirby, KCARP program, approached Council relative to the portable buildings located behind Ridgemont Terrace that house classrooms for the Kitsap County Alcohol Recovery Program. Mr. Asa requested a permit to continue use of these trailers which have been in use for approximately 4 years without an extension of the Temporary Use Permit being issued. Councilman Geiger moved to grant a Temporary Use Permit to allow the use of the trailer units located at Ridgemont Terrace Nursing Home by the Kitsap County Alcohol Recovery Program. This permit is to be renewed annually. Seconded. Councilman Caldwell moved to amend motion to state that Temporary Use Permit issuance be contingent upon applicant conforming with the City of Port Orchard Fire and Building Codes. Seconded and carried. Original amended motion carried. Mayor opened Public Hearing relative to proposed Federal Shared Revenue Budget as published on August 8, 1979. Citizens attending this hearing were representatives of the Port Orchard Senior Citizens and Laura Sheriff and Leone Atkins of the community performing arts group. Mayor Powers requested input from anyone in the audience as to how the $105,183.00 of Federal Shared Revenue monies could be used. Senior Citizens repeated their request for monies to subsidize use of Active Club Building. Ms. Leone Atkins renewed her request for $500.00 to establish a local community performing arts group. Clerk read proposed budget as published in hearing notice. On motion by Councilman Caldwell, seconded and carried, Council approved and adopted the Federal Shared Revenue Budget as proposed, Ordinance No. 1101. Mayor declared proposed Federal Shared Revenue Budget Hearing closed. Mayor opened Hearing relative to application for Special Use Permit as submitted by Christopher J.and Bera Bell and Steven G. Toole, owners of record for property located at 811 Sidney. Special Use Permit application requested permission to use this property for a law office and other non -retail professional offices. Clerk read Planning Commission's recommendation for approval of this Special Use Permit application and conditions recommended for approval. On motion by Councilman Caldwell, seconded and carried, Council approved Special Use Permit application as submitted by Christopher J. and Sera Bell and Steven G. Toole requesting permission to use their property which is zoned Residential High for Law Offices and other non -retail compatible professional offices contingent upon applicant complying with recommendations and conditions as set forth by the Planning Commission. O-rdinance No. 1102. Representative of the Farmers Market approached Council requesting permission to utilize Frederick Street Thursday evenings from approx- imately 6:00-8:00 P.M. for a Farmers Market. On notion by Councilman Geiger, seconded and carried, Council granted permission to utilize Frederick Street, Thursday evening, 6:00-8:00 P.M. for the Farmers Market. Mayor Powers declared recess with meeting to reconvene at 9:00 P.M. On motion by Councilman Wilson, seconded and carried, Council approved expenditure of approximately $100.00 for purchase of draperies (windows facing street), and flagstaff for the Library at 736 Prospect Street. On motion by Councilman Grosso, seconded and carried, Council moved that a letter, be written to the Kitsap County Commissioner's office relative to property owned by George Oakley, which was annexed to the City of Port Orchard on May 14, 1979. Letter is to request a prorated share of building permit fees charged Mr. Oakley by the Kitsap County Building Department and also request inspection rights on this project be transferred to the City. Mayor Powers d1rected Clerk to write a letter. Assistant Engineer Kane requested authorization to attend the International Public Works Congress to be held September 22--27, 1979 in Portland, Oregon. Registration fee is $100.00. On motion by Councilman Caldwell, seconded and carried, Council authorized expenditure of $100.00 (registration fee) and additional travel expenses by Assistant Engineer Kane to attend the International Public Works Congress to be held in Portland, Oregon, September.22-27., 1979. Mayor proclaimed the weekend of September 2 & 3, 1979 as "Jerry Lewis Muscular Dystrophy Telethon Weekend" and urged all citizens to support this worthwhile cause. On motion by Councilman Wilson, seconded and carried, Council approved Ordinance No. 1100, an ordinance amending City of Port Orchard Zoning Ordinance No. 899; by reclassifying property located on the Southeast corner of the intersection of Farragut Avenue North and Stockton Street from Residential High to Multiple family 20. Rezone request was sub- mitted by Gerald Schlie, Attorney representing Steven House. On motion by Councilman Caldwell, seconded and carried, Council approved Resolution No. 1213, confirming the job classification of Fire Inspector and providing for the salary thereof. On motion by Councilman Caldwell, seconded and 'carried, Council approved Resolution No. 1214 creating an Engineering -Planning Technician job classification and providing for the salary thereof. Councilman Clark set date of August 16, 1979, 8:00 P.M. for Water/Sewer Committee meeting. Councilman Geiger requested he be excused for the August 27, 1979 meeting as he will be on vacation on this date. Permission granted. Mayor Powers set date of August 23, 1979 for study session relative to proposed Fire, Light and Safety ordinance. Time: 7:30 P.M. On motion by Councilman Caldwell, seconded and carried, Council approved payment of the bills, (Vouchers No. 5989 through 6066) in the amount of $42,849.57 and the July payroll in the amount of $54.289.48, (Warrant #9143 - #9242).
