A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON, REVOKING SPECIAL USE PERMIT
SUP-1021.
WHEREAS, on July 22, 2002, the Council adopted Resolution No. 1985, finding the
permitee out of compliance with Special Use Permit SUP-1021, based upon the findings and conclusions
set forth therein, and allowing the permitee sixty days to bring the use into compliance or else have the
permit revoked; and
WHEREAS, the Council held a public hearing on October 14, 2002, in which the permitee
had the opportunity to present evidence that the use has been brought into compliance, and being fully
advised, the Council finds, concludes and resolves as follows:
FINDINGS
1. At the hearing, the permitee submitted the following evidence:
a. Letter from James H. Sullivan, Ph.D. dated October 9,
2002, with attached statistics regarding client activity
from May through September 2002.
b. Letter from J. Paul and JoAnn Killinger dated October
10, 2002.
2. The permitee presented no witnesses or testimony at the hearing.
3. Since the adoption of Resolution No. 1985, individual client hours per month
have increased from 170 to 182, and group client hours per month have
increased from 131 to 150.8.
4. The number of full and part-time counselors has not changed since the adoption
of Resolution No. 1985.
5. The type and character of the services provided have not changed since the
adoption of Resolution No. 1985.
6. No evidence was presented to indicate that on-site parking capacity has
increased since the adoption of Resolution No. 1985, or that parking demand
generated by the business has decreased.
CONCLUSIONS
Permitee has failed to provide sufficient evidence that the use has been brought into
compliance with SUP-1021, as required by Resolution No. 1985.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY RESOLVES AS FOLLOWS:

Pursuant to Resolution No. 1985 and Chapter A 1 Section 14 of the Port Orchard Zoning
Ordinance, Special Use Permit SUP-1021 is hereby revoked.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 28'h day of October, 2002.
