2001 - Resolution - Annexation by ElectionRESOLUTION NO. 2001 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, PURSUANT TO RCW35.13.015 CALLING FOR THE ANNEXATION BY ELECTION OF AN AREA OF UNINCORPORATED TERRITORY BEING CONTIGUOUS TO THE CITY AND LEGALLY DESCRIBED IN SECTION 1 OF THIS RESOLUTION, AND ALSO CALLING FOR AN ELECTION WITHIN THE TERRITORY ON THE PROPOSITIONS OF WHETHER UPON ANNEXATION ALL PROPERTY ANNEXED: SHALL BE ASSESSED AND TAXED AT THE SAME RATE AND ON THE SAME BASIS AS PROPERTY WITHIN THE CITY OF PORT ORCHARD IS ASSESSED AND TAXED TO PAY FOR ALL OR ANY PORTION OF THE OUTSTANDING INDEBTEDNESS OF THE CITY OF PORT ORCHARD; AND SHALL CONTINUE TO BE ZONED AS PROVIDED FOR IN THE KITSAP COUNTY CODE TITLE 17. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, AS FOLLOWS: SECTION 1. That the best interests and general welfare of the City of Port Orchard would be served by the annexation of an area of unincorporated territory being contiguous to the City and legally described as follows: That portion of the Northeast quarter of the Southeast quarter of Section 10, Township 23 North, Range 1 East, W.M. in Kitsap County, Washington, described as follows: Beginning at the Northeast corner of the Northeast quarter of the Southeast quarter of said Section 10; thence South 2'26'39" West along the East line thereof a distance of 922.48 feet the North line of the South 400 feet of said Northeast quarter of the Southeast quarter; thence north 87'40'53" West along said North line a distance of 30.00 feet to the West right-of-way margin of Sidney Road being the TRUE POINT OF BEGINNING; thence continuing North 87'40'53" West along said North line a distance of 630.00 feet; thence North 2'26'39" East 548.90 feet to the South line of the North 375 feet of said Northeast quarter of the Southeast quarter; thence South 87'33'27" East along said South line a distance of 630.00 feet to said right-of-way margin of Sidney Road; thence South 2'26'39" West along said right-of-way margin a distance of 547.54 feet to the true point of beginning, together with that portion of Sidney Road SW abutting thereon. SECTION 2. That, as nearly as may be determined, the number of voters residing in the area of the aforesaid territory is 2. SECTION 3. That the City Council hereby calls for an election to be held pursuant to RCW 35.13 to submit to the voters of the aforesaid territory the proposal for annexation. SECTION 4. That there shall also be submitted to the electorate of the territory sought to be annexed a proposition that all property within the area to be annexed shall, upon annexation, be assessed and taxed at the same rate and on the same basis as property within the City of Port Orchard is assessed and taxed to pay for all or any portion of the outstanding indebtedness of the City of Port Resolution No. 2001 Page 2 of 2 Orchard, which indebtedness has been approved by the voters, contracted for, or incurred prior to, or existing at, the date of annexation. SECTION 5. That there shall also be submitted to the electorate of the territory sought to be annexed a proposition that all property within the area to be annexed shall, upon annexation, continue to be zoned as provided for in Kitsap County Code Title 17. SECTION 6. That the cost of said annexation election shall be paid by the City of Port Orchard. SECTION 7. That the City Clerk shall file a certified copy of this resolution with the Clerk of Kitsap County Board of Commissioners and shall also file a certified copy of this resolution with the Kitsap County Boundary Review Board. SECTION 8. That the City Clerk shall file with the Kitsap County Boundary Review Board a notice of intention hereof, as required by RCW 36.93090 et seq.
