A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON
APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO
QWEST COMMUNICATIONS FOR PROPERTY LOCATED AT 2386
SIDNEY AVENUE FOR A SPECIFIC USE OF A PARCEL OF PROPERTY
WHICH IS IN HARMONY WITH THE VARIOUS ELEMENTS OR
OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS NOT
DETRIMENTAL TO EXISTING USES PERMITTED IN THAT
PARTICULAR ZONE.

WHEREAS, the City Planning Commission has held the required public meeting in
accordance with the criteria set forth in Chapter 83: Permitted, conditional, and special use tables of
Ordinance No. 1748, Zoning Ordinance of the City of Port Orchard and in the Planning and Development
Procedures established under Resolution No. 1844, and in conformance with ESHB 1724, and;
WHEREAS, the City Planning Commission recommended approval of the Conditional
Use Application as submitted by Qwest Communications to construct a 3,800sf addition to the existing
6,900sf structure currently used as a telecommunications switching facility; and has recorded with the City
Clerk their decision setting forth their findings, and
WHEREAS, the proposed purposes of this request is to fulfil the increased needs for
telephone, fax, e-mail, and Internet communication services; and
WHEREAS, the existing structure was established in 1973 as a communications facility
prior to the requirements of a conditional use permit. The use is currently classified as a subregional utility
and as such is allowed in the residential zone subject to the requirements of a conditional use permit; and,
WHEREAS, the City Council did hold a public hearing on September 24, 2001 to take
testimony,-review materials and consider-all information presented, now therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE:
Approve the issuance of a Conditional Use Permit to construct a 3,800sf addition to the
existing 6,900sf structure currently used as a telecommunications switching facility with the following 7
conditions:
1. An approved lighting plan is required prior to building permit approval indicating
existing and proposed light fixtures, including the pole heights. Each fixture shall
have cut-offs, or shielding to ensure that glare does not wash off the property into
the right-of-way, or the surrounding neighboring properties.
2. An approved Landscape Plan and Maintenance Agreement is required prior to
building permit approval.
3. A Temporary Use Permit is required for the existing mobile office and fleet
parking prior to approval of the conditional use permit.
4. The mobile office and fleet parking activity shall be relocated to a suitable site
prior to the commencement of construction.
5. An approved stormwater permit is required prior to building permit approval.
6. All conditions identified by City Departments and other agencies must be met
prior to the issuance of the building permit.
7. All proposals of the applicants are herein made conditions of approval. .
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the Clerk in authentication of such passage this 8~ ay of October 2001.
