1921 - Resolution - Policy for Site Visits by Council and Planning MembersRESOLUTION NO. 1921 A RESOLUTION OF THE CITY OF PORT ORCHARD, ESTABLISHING THE POLICY FOR SITE VISITS BY COUNCIL AND PLANNING COMMISSION MEMBERS FOR LAND USE DECISIONS. WHEREAS, the City of Port Orchard administers its land use regulations in accordance with the Comprehensive Plan and Zoning Ordinance, and WHEREAS, the City Council and the City Planning Commission have the responsibility to process land use actions, such as rezones, variances, special use permits, and other matters, and WHEREAS, certain land use actions before the City Council and Planning Commission are quasi-judicial proceedings; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON: (1) Site visits of the property subject to a land use application are permissible, subject to the following guidelines: (a) City Council and Planning Commission members are not restricted from visiting property if they have not been advised that a land use action for that property has been accepted by the city. (b) Once a land use action has been accepted by the city for a specific property, City Council and Planning Commission members should not perform a site visit until the member has been provided the preliminary or final staff report. (c) The site visit should be made after the City Council or Planning Commission member has reviewed the staff report and is familiar with the issues associated with the land use action. (d) When the City Council and Planning Commission member does perform the site visit, that member should not inspect the site with any other City Council and Planning Commission member, property owner, neighbor, or other person who is involved in the land use decision. (e) When the land use public meeting or hearing is held, the City Council and Planning Commission members shall state for the record if they had made a site visit in accordance with city policies. Resolution No. 1921 Page2 of2 (2) This policy does not prohibit or infringe upon City Council and Planning Commission members from visiting properties that they have business, governmental functions, or other obligations. Examples of this exclusion would be a land use application concerning City Hall, Kitsap County Courthouse, places of work, commerce, or other similar community interfaces.
