1892 - Resolution - Repealing Resolution No. 1858 and Re-establishing a policy for cutting treesRESOLUTION NO. 1892 A RESOLUTION OF THE CITY OF PORT ORCHARD REPEALING RESOLUTION NO. 1858 AND RE-ESTABLISHING A POLICY FOR CUTTING TREES AND VEGETATION IN THE RIGHT OF WAY AND ON PUBLIC PROPERTY. WHEREAS, the City of Port Orchard maintains the public right of way and lands owned by the city, and WHEREAS, the city is periodically required to trim vegetation for safety and aesthetic purposes, and WHEREAS, the city does receive requests for removal of specific trees and vegetation, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON HEREBY RESOLVES AS FOLLOWS: SECTION 1. The following is the city's policy for removing trees and other vegetation in the right of way and on city owned property: entirety. (1) If the city deems a city tree or vegetation dangerous, it will have the tree cut or trimmed at city expense. (2) If the city tree or vegetation is not dangerous and a person wants it trimmed or removed, the cost' of that effort would be paid for by the person making the request. (3) Trees or vegetation will not be cut without city approval. The city is not required to approve a request to trim or cut vegetation. Each request shall be considered on it own merits. (4) City trees or vegetation shall be cut by city employees or professionals, who have the required bonds and insurance. (5) Residential and commercial landscaping and landscaping maintenance within the right of way is allowed, unless specifically prohibited by the city. (6) The city may issue view easements for a specific amount of time to allow trees and vegetation in the right of way to be maintained, trimmed, or removed and replaced. SECTION 2. REPEALER.
