1914 - Resolution - Notice of Intent to Annext TerritoryRESOLUTION NO. 1914 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON GIVING NOTICE OF INTENT TO ANNEX TERRITORY INTO THE CITY OF PORT ORCHARD FOR MUNICIPAL PURPOSES INCLUDING WASTEWATER TREATMENT FACILITY PROPERTY ANNEXED UNDER ORDINANCE NO 1236 (7/25/83) TO CORRECT LEGAL DESCRIPTION WHEREAS, the City of Port Orchard is the owner of Tax Parcels No 4689-002-001-0104 and 4538-010~003-0009 (the Property), which are located in Kitsap County, Washington and legally described as follows: LEGAL DESCRIPTION: That portion of Gaflner Park and Lot 1 of Block 7, Plat of Gaflner's Garden Tracts, Volume 2, Page 61 of Plats and that portion of Block B, and Lot 1 of Block C of the Re-plat of Gaflne~s Garden Tracts, Volume 2, Page 89 of Plats, and that portion of vacated Daniel Avenue and Port Orchard Street and Front Street, per Kitsap County Commissioner's Journal, Volume 3, Page 326, and that portion of vacated Beach Drive, Bay Street and Olney Avenue, per Kitsap County Commissioners Journal, Volume 13, Page 337 and Volume 15, Page 242, all in the Northeast quarter of Section 25, Township 24 North, Range 1 East, W.M. in Kitsap County, Washington, described as follows: Commencing at the East one-quarter comer of said Section 25; thence North 1 o 15' 24" East, along the East line of the Northeast quarter of Section 25, 1924.48 feet, to the centerline of County Road (Bay Street); thence North 72° 36' 57" West, along centerline of Bay Street, 221.24 feet; thence continuing along the centerline of Bay Street; North 85° 38' 37" West, 684.22 feet; thence leaving said centerline, South 4° 21' 23" West, 30.00 feet to the South right-of- way margin of Bay Street and the True Point of Beginning; thence South 85° 38' 37" East, along said South margin, 111.89 feet to a point of curvature; thence Southeasterly along a curve to the right, having a central angle of 79° 14' 02" and a radius of 35.00 feet for an arc distance of 48.40 feet to a point on the Westerly right-of-way margin of Olney Avenue; thence South 6° 24' 35" East, along said Westerly margin, 855.33 feet; thence continuing along said Westerly margin South so 44' 55" West, 82.44 feet; thence leaving said Westerly margin North 88° 20' 59" West, along the South line of that certain property as described in deed recorded under Kitsap County Audito~s File No. 35866, 257.97 feet; thence North 19° 45' 1 0" East, 133.09 feet; thence North 16° 23' 27" West, 185.57 feet; thence North oo 13' 42" West, 87.99 feet; thence North 21o 20' 01" East, 45.33 feet; thence North 49o 59' 19" East, 59.30 feet; thence North 85° 38' 37" West, 185.44 feet; thence North go 23' 28" East, 200.57 feet, to a point of curvature; thence Northwesterly along a curve to the left, having a central angle of 29° 21' 49", and a radius of 362.69 feet for an arc distance of 185.88 feet; thence North 19° 58' 21" West, 76.86 feet, to a point of curvature; thence Northeasterly along the arc of a curve to the right having a central angle of 124° 11' 18", and a radius of 35.00 feet for an arc distance of 75.86 feet to a point of reverse curvature; thence Easterly along a curve to the left, the center point of said curve lying North 14° 12' 57" East, 746.78 feet, through a central angle of go 51' 34", for an arc distance of 128.50 feet to the True Point of Beginning. Note: The above legal description includes parcels previously annexed by the City of Port Orchard Ordinance No. 1236 (July 1983). A pictorial illustration of the Property being attached hereto; and WHEREAS, the Property is comprised of 5.2 acres and is the site of the Wastewater Treatment Facility; and WHEREAS, a 2.5 acre portion of the Property was recenUy acquired by the city to be used for municipal sewerage purposes as an integral part of the city's wastewater treatment facility; and WHEREAS, in 1983 the City of Port Orchard annexed 2.7 acres of the Property, which is located in the southwest corner of the Beach Drive/Olney Avenue intersection for municipal purposes; and WHEREAS, on February 15, 2000 the City of Port Orchard and the Veteran's Home Washington Department of Veterans Affairs filed a Declaration of Boundary Line Adjustment correcting the boundaries and legal description of the property annexed in 1983; and Resolution No. 1914 Page 2of 2 WHEREAS, it is the desire of the City of Port Orchard to correct the legal description set forth in Ordinance No. 1236; and WHEREAS, it is the intent of the City Council to annex the recently acquired 2.5 acres of the Property; and WHEREAS, the Property is outside the city limits and is not contiguous to the city's boundaries; and WHEREAS, RCW 35.13.180 provides for annexation of property that is non-contiguous to the city limits if it is to be used for municipal purposes, now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON: SECTION 1. It is the intent of the City of Port Orchard to annex the 2.5-acre portion of property adjacent to the wastewater treatment facilily located in the southwest corner of the Beach Drive/Olney Avenue intersection. SECTION 2. It is the intent of the City Council to correct the boundaries and legal description of the 2.7 acres annexed in 1983 by Ordinance No. 1236 by including that property and the property within the area of the Boundary Line Adjustment within the legal description of this annexation, and SECTION 3. The City Council authorizes the Mayor to submit this matter to the Kitsap Boundary Review Board and to prepare and process this matter as is necessary to effectuate the Council's intent to annex the Property and correct the legal description set forth in Ordinance No. 1236, which was approved on July 1983.
