Attachment "A"— complete legal description WHEREAS, the City Planning Commission has held the required public meeting in accordance with the criteria set forth in Chapter 133: Permitted, conditional, and special use tables of Ordinance No. 1748, Zoning Ordinance of the City of Port Orchard and in the Planning and Development Procedures established under Resolution No. 1844, and in conformance with ESHB 1724, and; WHEREAS, the City Planning Commission recommended approval of the Conditional Use Application as submitted by the Port of Bremerton to expand the Water Street Boat Launch at 541, 545 and 551 Bay Street and has recorded with the City Clerk their decision setting forth their findings, and WHEREAS, affected property owners may request a change in valuation for property tax purposes notwithstanding any program of revaluation, and WHEREAS, the City Council did hold a public hearing on July 26, 1999 to take testimony, review materials and consider all information presented, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE: Approve the issuance of a Conditional Use Permit to expand the Water Street Boat Launch at 541, 545 and 551 Bay Street with the following 6 conditions: Resolution No 1868 Page Two of Two Prior to commencement of work, a building permit shall have been issued from the City of Port Orchard for this project and approval from the Department of Ecology received. 2. The project is conditioned to the site plan submitted on June 16, 1999. Any major modifications (either additions or deletions) to the approved site plan must be approved by the City Council. 3. Stormwater controls shall comply with Department of Ecology standards. 4. The developer must apply for and be issued addresses prior to building permit issuance. 5. Prior to building permit issuance, a landscape plan must be submitted and approved. 6. All signage must comply with the Sign Code. No signage shall be erected without a valid permit.
