1745 - Resolution - Denying Issuance of Special Use PermitRESOLUTION NO. 1745 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON DENYING THE ISSUANCE OF A SPECIAL USE PERMIT TO ROGER AND SHIRLEY JOHNSON FOR PROPERTY LOCATED AT 1730 POTTERY AVENUE FOR A SPECIFIC USE OF A PARCEL OF PROPERTY WHICH IS NOT IN HARMONY WITH THE VARIOUS ELEMENTS OR OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS DETRIMENTAL TO EXISTING USES PERMITTED IN THAT PARTICULAR ZONE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE: THAT: Whereas the City Planning Commission held the required public hearing in accordance with the criteria set forth in Chapter 6 (Special Use Permits) of Ordinance No. 1469, Zoning Ordinance of the City of Port Orchard, and WHEREAS, the City Planning Commission has recommended approval of the application by Roger and Shirley Johnson for property located at 1730 Pottery Avenue, and has recorded with the City Clerk their decision setting forth their findings and recommendations, and WHEREAS, the Port Orchard City Council held a public hearing on July 8, 1996 to consider Roger and Shirley Johnson's Special Use Permit Application, and WHEREAS, the Port Orchard City Council did consider testimony and evidence relevant to the Special Use Permit Application. NOW, THEREFORE, the City Council of the City of Port Orchard does hereby deny the issuance of a Special Use Permit to Roger and Shirley Johnson for property located at 1730 Pottery Avenue based upon the following findings of fact and conclusions: FINDINGS OF FACT: I. That the use applied for is a proper one for which a Special Use Permit may be authorized by the Zoning Code, 2. That because the proposed conversion of a single family residence into a full service hair salon is located in an existing single family residential neighborhood, it is neither desirable nor necessary for the development of the community. 3. That the loss of an existing single family residence for conversion into a business is inconsistent with the Comprehensive Plan's goals and policies which seek to ensure an adequate amount and variety of affordable housing are available. That the proposed use is inconsistent with the adopted Comprehensive Plan map which identifies the long-term use of the site for high density residential development, not commercial use. 5. That due to the highly transitory nature of the proposed use, traffic impacts would be both detrimental and deleterious to existing uses and to uses specifically permitted in the underlying land use district. CONCLUSION: Based on the findings of facts, testimony and materials presented at the public hearing, the Port Orchard City Council conclude that: (1) A special use permit to allow a full service hair styling salon located at 1730 Pottery Avenue would not be in harmony with the general purpose of the city zoning ordinance nor comprehensive plan designations. (2) The proposed use of the subject property is not compatible with the surrounding residential neighborhood. (3) The proposed use of the subject property is not in furtherance to the health, safety, morals and general welfare of the community.
