1750 - Resolution - Agreement with Kitsap County Regarding ULID #6RESOLUTION NO. 1750 ,/ A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON APPROVING AND RATIFYING THE AGREEMENT REGARDING THE TRANSFER OF ASSETS AND ASSUMPTION OF OBLIGATIONS OF UTILITY LOCAL IMPROVEMENT DISTRICT NO. 6 FROM KITSAP COUNTY. WHEREAS, Kitsap County ("the County") passed Resolution No. 142-1995 forming Utility Improvement District ("ULID") No. 6 for the purpose of providing sewerage service for properties within the boundaries of ULID No. 6; and WHEREAS, the County does not own or operate a sewage treatment plant currently capable of processing the sewerage from ULID No. 6; and WHEREAS, the City of Port Orchard ("the City") is a municipal corporation providing sewerage services in South Kitsap County, which services include a secondary treatment plant; and WHEREAS, subject to the provisions of RCW 36.94,190, the County and the City are authorized to enter into contracts for the establishment, maintenance, and operation of a sewage system; and WHEREAS, the City and the County entered into an Agreement ("the Agreement") on September 12, 1994, pursuant to RCW 39.34 and/or other applicable legislative provisions, under which the City and the County agreed that upon completion of the ULID No. 6 facility, the facility would be transferred to the City for responsibility, maintenance and operation of the sewerage system facilities within the boundaries of ULID No. 6; and WHEREAS, The City Council of the City of Port Orchard finds that it is in the public interest and conducive to the public health, safety, welfare and convenience of the City to transfer the ULID No. 6 facilities to the City of Port Orchard; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, approves and ratifies the Agreement attached hereto and incorporated by this reference herein as "Exhibit A" and the City is hereby authorized to enter into such Agreement with Kitsap County for the transfer of the sewerage service facilities within ULID No. 6.
