1753 - Resolution - Petition Regarding ULID #6RESOLUTION NO. 1753 ✓ A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING THE MAYOR OF THE CITY OF PORT ORCHARD TO SIGN A PETITION REQUESTING THAT THE KITSAP COUNTY SUPERIOR COURT APPROVE THE "AGREEMENT REGARDING THE TRANSFER OF ASSETS AND ASSUMPTION OF OBLIGATIONS OF UTILITY LOCAL IMPROVEMENT DISTRICT NO, 6 TO THE CITY OF PORT ORCHARD". WHEREAS, Kitsap County ("the County") passed Resolution No. 017-1993, forming Utility Local Improvement District ("ULID") No. 6 for the purpose of providing sewerage service for properties within the boundaries of ULID No. 6, number in all instances No. 6; and WHEREAS, the City and the County entered into an Agreement ("the Agreement") on September 12, 1994, pursuant to RCW 39.34 and/or other applicable legislative provisions, under which the City and the County agreed that upon completion of the ULID No. 6 facility, the facility would be transferred to the City for responsibility, maintenance and operation of the sewerage system facilities within the boundaries of ULID No. 6; and WHEREAS, the City Council of the City of Port Orchard finds that it is in the public interest and conducive to the public health, safety, welfare and convenience of the City to transfer the ULID No. 6 facilities to the City of Port Orchard; and WHEREAS, RCW 39.94.410 directs that the transfer of a sewerage system be done in the manner directed in the RCW 36.94.310 through RCW 36,94.340; and WHEREAS, RCW 36.94.340 mandates that the Port Orchard City Council specifically authorized its Mayor to sign a petition and submit it to Superior Court; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, hereby authorizes the Mayor to sign a petition prepared and or approved as to form by the City Attorney's office that will be submitted to Kitsap County Superior Court requesting approval of the "Agreement Regarding the Transfer of Assets and Assumption of Obligations of Utility Local Improvement District No. 6 to the City of Port Orchard". PASSED by the City Council of the City of Port Orchard, APPROVED by the mayor and attested by the Clerk in authentication of such passage this 23rd day of September, 1996. LESLIE J.
