1694 - Resolution - Conditional Use PermitRESOLUTION NO. 1694 v/ A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON PROVIDING A CONDITIONAL USE PERMIT FOR DREDGING AT THE SINCLAIR INLET MARINA, AS REPRESENTED BY MR W.J. TIERNAN, 501 BAY STREET. WHEREAS, the City of Port Orchard has issued SDP 39-88 to construct the Sinclair Inlet Marina; and WHEREAS, the Marina has requested an additional Substantial Development Permit to dredge -in vicinity of Float A to allow use of that float; and WHEREAS, the proposal has received a Determination of Non -Significance after a review of the SEPA environmental checklist; and WHEREAS, a public hearing was held on February 13, 1995 by the City Council to hear facts and testimony concerning granting a Conditional Use and Variance with regard to the Shoreline Management Program; WHEREAS, the City Council has determined that the granting of a Conditional Use Permit to allow the dredging approximately 3,000 cubic yards of sediment at Float A of the Sinclair Inlet Marina is consistent with the intent of the Shoreline Management Program, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, DOES HEREBY RESOLVE THE FOLLOWING: The City of Port Orchard recommends the following conditions: I. The dredging cannot commence until the applicant secures both the Department of Fisheries Hydraulic Application Permit and the US Army Corps of Engineers permits. 2. The Conditional Use Permit is only valid for the initial dredging. Any maintenance dredging in the future must conform with the regulatory requirements of that time. 3. Dredging will not commence until the City issues an excavation permit and has copies of the approved Fisheries and Corps of Engineers permits.
