1698 - Resolution - Special Use PermitRESOLUTION NO. 1698 ✓ A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON APPROVING THE ISSUANCE OF A SPECIAL USE PERMIT TO AMERICAN LEGION POST #30 FOR PROPERTY LOCATED AT 615 KENDALL STREET FOR A SPECIFIC USE OF A PARCEL OF PROPERTY WHICH IS IN HARMONY WITH THE VARIOUS ELEMENTS OR OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS NOT DETRIMENTAL TO EXISTING USES PERMITTED IN THAT PARTICULAR ZONE. THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES HEREBY RESOLVE: THAT: Whereas the City Planning Commission has held the required public hearings in accordance with the criteria set forth in Chapter 6 (Special Use Permits) of Ordinance No. 1469, Zoning Ordinance of the City of Port Orchard, and; WHEREAS, the City Planning Commission has recommended approval of the application by the American Legion Post #30, located at 615 Kendall Street and has recorded with the City Clerk their decision setting forth their findings and recommendations, and WHEREAS, the City Council did hold a public hearing on March 27, 1995 to take testimony, review materials and consider all information presented. NOW, THEREFORE, the City Council of the City of Port Orchard does adopt Planning Commission Resolution No. 227-95, (Attachment "A") with Findings, Facts and Conclusions as their own and does hereby approve the issuance of a Special Use Permit to allow the conversion of a public works garage and storage yard into a new American Legion Hall, with the following six conditions: 1. A building permit shall be obtained prior to any construction on the site. 2. All renovations to the site must comply with the Zoning Code. 3. Contingent upon the provision of 15 parking spaces at the Givens Center, the project site must provide only 20 spaces on site if the addition is constructed as shown on the preliminary site plan. Otherwise, the site must provide the total number of required parking spaces as required in the Zoning Code. Resolution No. 1698 Page Two of Two 4. Landscaping requirements which pertain to commercial uses shall apply to this site to help buffer the use from adjoining residences as best determined by the City Planner. 5. A lighting plan shall be submitted and approved prior to placement of outdoor illumination and shall be oriented away from neighboring residences. 6. This Special Use Permit is contingent upon the sale and transfer of property with the City. Otherwise this permit shall be null and void. LEGAL DESCRIPTION: SEE EXHIBIT A. WHEREAS, a Public Hearing was held on Tuesday, 21 February 1995, and the Planning Commission considered the findings and facts of the proposal, testimony, and materials presented at the Hearing; and WHEREAS, the applicants requested a Special Use Permit to allow the conversion of a public works garage and storage yard into a new American Legion Hall; and WHEREAS, the Planning Commission considered the specific use proposed to be appropriate as conditioned; and WHEREAS, the proposed use is in keeping with other nearby service and community orientated uses in the neighborhood, specifically; the Givens Community Center, the Babe Ruth baseball, fields, the Masonic Lodge and the Active Club; and WHEREAS, the proposed use, as demonstrated in supporting documentation provided by the applicant and as conditioned, will not be detrimental to the public health, safety, welfare or injurious to property and improvements in the vicinity and therefore will be in conformance with the objectives of the Comprehensive Plan. WE THEREFORE FIND: that the proposed Special Use Permit to allow the conversion of a public works garage and storage yard into the new American Legion Hall is compatible with the surrounding land uses and will not have a detrimental effect on the surrounding community. CONCLUSION, based on the facts, testimony, and materials presented at the Hearing, we therefore conclude that the Special Use Permit to allow the conversion of a public works garage and storage yard into the new American Legion Hall is in harmony with the general purposes of the boning Ordinance and the Comprehensive Plan.
