1701 - Resolution - Denying Special Use PermitRESOLUTION NO. 1701 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON DENYING THE SPECIAL USE PERMIT TO DONALD AND ANNA RYAN FOR PROPERTY LOCATED AT 1003 SIDNEY AVENUE FOR A SPECIFIC USE OF A PARCEL OF PROPERTY WHICH IS NOT IN HARMONY WITH THE VARIOUS ELEMENTS OR OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS DETRIMENTAL TO EXISTING USES PERMITTED IN THE RESIDENTIAL HIGH DENSITY ZONE. THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE: THAT: Whereas the City Planning Commission held the required public hearing in accordance with the criteria set forth in Chapter 6 (Special Use Permits) of Ordinance No. 1469, Zoning Ordinance of the City of Port Orchard, and WHEREAS, the City Planning Commission has recommended denial of the application by Donald and Anna Ryan for property located at 1003 Sidney Avenue, and has recorded with the City Clerk their decision setting forth their findings and recommendations, and WHEREAS, the Port Orchard City Council held a public hearing on July 10, 1995 to consider Donald and Anna Ryan's Special Use Permit Application, and WHEREAS, the Port Orchard City Council did consider testimony and evidence relevant to the Special Use Permit Application. NOW, THEREFORE, the City Council of the City of Port Orchard does hereby deny the Special Use Permit to Donald and Anna Ryan for property located at 1003 Sidney Avenue based upon the following findings of fact and conclusions: FINDINGS OF FACT: 1) Parking for professional offices requires one (1) space for each 4 employees. The proposed off-street parking for the use does not meet zoning ordinance requirements. 2) That the site for the intended use is adequate in size and shape to accommodate said use. The site is already non -conforming since it does not provide enough parking for the primary use (residence) on site. Resolution No. 1701 Page Two of Two CONCLUSION: Based on the findings of facts, testimony and materials presented at the public hearing, the Port Orchard City Council conclude that: (1) A special use permit to allow professional offices at 1003 Sidney Avenue would not be in harmony with the general purposes and intent of the city zoning ordinance nor surrounding comprehensive plan designations. (2) The proposed use of the subject property is not compatible with the surrounding residential neighborhood. (3) The proposed use of the subject property is not in furtherance to the health, safety, morals and general welfare of the community. LEGAL DESCRIPTION: Section 35, Township 24 Range 1E, Sweany's Second Addition to Sidney, Lot 1 and 2, Block 1, Sweany's Second Addition to Sidney, according to the Plat thereof, recorded in Volume 2 of Plats, Page 18, Records of Kitsap County, Washington.
