1660 - Resolution - Public Hearing on Petition to Vacate ROWRESOLUTION NO. 1660 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, FIXING THE DATE OF PUBLIC HEARING ON A PROPOSAL TO VACATE A PORTION OF BAY STREET AND A PORTION OF AN UNNAMED RIGHT OF WAY TO AID THE IMPLEMENTATION OF THE URBAN WATERFRONT WALKWAY PLAN (Kasprisin Plan AS ADOPTED BY RESOLUTION NO. 1392). WHEREAS, the Port Orchard City Council did on May 28, 1985 adopt Resolution No. 1392 which amended the Comprehensive Park Plan to include the Urban Waterfront Walkway Plan; and WHEREAS, an integral part of the Urban Waterfront Walkway Plan is a public observation/resting facility at Mitchell Point; and WHEREAS, it is the intent and desire of the Port Orchard City Council to acquire additional property to aid in the implementation of the Urban Waterfront Walkway Plan; and WHEREAS, RCW 35.79.035 provides procedures for vacating streets abutting bodies of water, and WHEREAS, pursuant to RCW 35.79.035(b) the Port Orchard City Council does declare that portion of Bay Street and the unnamed right of way described as follows is not presently being used as a street or alley and that the right of way is not suitable for any of the following purposes: Port, beach or water access, boat moorage, launching sites, park, public view, recreation or education; and WHEREAS, this vacation action is sought to enable the City of Port Orchard to acquire property that will provide improved public access to the same shoreline area which the portion of Bay Street and the unnamed right of way abut. WHEREAS, it is proposed that in accordance with RCW 35.79.035(3) the City obtain a cash payment and Lots 3 & 4, Block 32 Sidney Tidelands in trade for the following described right of ways. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Port Orchard, Washington, as follows: THAT a Public Nearing on a proposal to Vacate a portion of Bay Street and an unnamed right of way further described as follows, is hereby fixed for Monday, March 28, 1994 at 7:35 P.M. in the City Council Chambers, City Hall, 216 Prospect Street, Port Orchard, Washington. LEGAL DESCRIPTION: That portion of Government Lot 3, and the First Class Tidelands adjoining Section 25, Township 24 North, Range 1 East, W.M., in Kitsap County, Washington, described as follows: Commencing at the Southeast corner of Lot 1, Block 23, Plat of Annapolis, according to the plat thereof, recorded in Volume 1 of Plats, Page 64, records of Kitsap County, Washington, which is the True Point of Beginning; thence 85 feet Northeasterly along the West margin of the Bay Street right of way; thence 35 feet Southeasterly along a line perpendicular to the West margin of said Bay street; thence 85 feet Southwesterly Resolution No. 1660 Page 2 of 2 along a line parallel to the West margin of said Bay street; thence 35 feet Northwesterly along a line which is perpendicular to the West margin of said Bay street to the True Point of Beginning AND TOGETHER WITH the un-named right of way which is West of Bay Street and is between Blocks 23 and 32, Sidney Tidelands.
