1673 - Resolution - Kitsap County's Conservation Easement ProgramRESOLUTION NO. 1673 ✓ A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, SUPPORTING A PETITION FOR REVIEW REGARDING KITSAP COUNTY'S CONSERVATION EASEMENT PROGRAM. WHEREAS, the Kitsap County Board of Commissioners adopted a Zoning Ordinance amendment on February 28, 1994, which added a subsection to provide for the transfer of rural density through a "Conservation Easement" process; and WHEREAS, the amendment allows and encourages development in rural areas to concentrate at urban densities but outside designated Interim Urban Growth Areas; and WHEREAS, the adopted process provides opportunities for large property owners to evade the possible effects of future forest resource land designation and protective regulations; and WHEREAS, Kitsap County has not yet designated forest resource lands, nor adopted regulations to conserve them, as required by the Growth Management Act and, to date, has failed to acknowledge that Kitsap County has any such lands; and WHEREAS, the amendment does not appear to be consistent with the intent of the Growth Management Act, with the planning goals of RCW 36.70A.020, nor with the adopted County wide Planning Policies that would direct most new development into existing cities and Urban Growth Areas; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE THE FOLLOWING: THAT, The City of Port Orchard, Washington supports the Petition for review of the Kitsap County Conservation Easement Process that has been submitted to the Central Puget Sound Growth Planning Hearings Board by Kitsap Citizens for Rural Preservation, et al. PASSED by the City Council by the Mayor and attest by the Clerk in 11th day of July, 1994.
