1550 - Resolution - Special Use PermitRESOLUTION NO. 1550 v A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON APPROVING THE ISSUANCE OF A SPECIAL USE PERMIT TO TOM JEATRAN AND RICHARD GRANQUIST FOR PROPERTY LOCATED IN THE NORTHWEST CORNER OF SR160 AND THE HIGH SCHOOL ACCESS ROAD FOR A SPECIFIC USE OF A PARCEL OF PROPERTY WHICH IS IN HARMONY WITH THE VARIOUS ELEMENTS OR OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS NOT DETRIMENTAL TO EXISTING USES PERMITTED IN THAT PARTICULAR ZONE. THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE: THAT: Whereas the City Planning Commission has held the required public hearings in accordance with the criteria set forth in Chapter 6 (Special Use Permits) of Ordinance No. 1469, Zoning Ordinance of the City of Port Orchard, and; WHEREAS, the City Planning Commission has recommended approval of the application by Tom Jeatran and Richard Granquist located at the northwest corner of SR160 and the High School Access Road, and has recorded with the City Clerk their decision setting forth their findings and recommendations. NOW, THEREFORE, the City Council of the City of Port Orchard does adopt Planning Commission Resolution No. 152-90, with Findings, Facts and Conclusions as their own and hereby approves the issuance of a Special Use Permit to allow a mini -storage facility, and set additional conditions: (1) The Department of Fisheries shall issue the hydraulic application permit prior to any excavation of the property; (2) A silt and erosion control plan be submitted and approved prior to any issuance of the excavation or building permit; (3) Fire hydrants be placed as required by the Fire Chief; (4) Access to SR160 be limited to right -in and right -out. The access is to be designed in such a way that forces vehicles to comply with the right -in and right -out requirements, in accordance with the conditions imposed by Ordinance No. 1469, Chapter 6. LEGAL DESCRIPTION: Section 25, Township 24 North, Range 1 East WM, Kitsap County: The northerly 405 feet of that portion of the southeast quarter of the southwest quarter of said section, described as follows: Beginning at the southwest corner of the east half of the southeast quarter of said southwest quarter; thence north 660 feet, thence east 209 feet; thence south 627 feet; thence west 197 feet; thence south 33 feet; thence west to the point of beginning; except State Highway 14 (SR160) along the south boundary. TOM JEATRAN AND MR. RICHARD GRANQUIST. LEGAL DESCRIPTION: Section 25, Township 24 North, Range 1 East WM, Kitsap County: The northerly 405 feet of that portion of the southeast quarter of the southwest quarter of said section, described as follows: Beginning at the southwest corner of the east half of the southeast quarter of said southwest quarter; thence north 660 feet, thence east 209 feet; thence south 627 feet; thence west 197 feet; thence south 33 feet; thence west to the point of beginning; except State Highway 14 (SR 160) along the south boundary. WHEREAS, the applicant has requested a special use permit to construct a mini -storage facility of approximately 425 units plus an office and residence for the manager, and WHEREAS, the public hearing was held on 16 July 1990, and the Planning Commission considered the findings of fact, the testimony and materials presented at the hearing, and WHEREAS, a SEPA environmental checklist was submitted and received a declaration of non -significance, and WHEREAS, the property is zoned Commercial General and has a current special use permit to allow 233 units of mini -storage, and, WHEREAS, the project will have a minimum impact on the existing infrastructure and road system, and WHEREAS, the proposed use is in harmony with the objective of the comprehensive plan and is not detrimental to existing uses, and WHEREAS, the site is adequate to accommodate the proposed use, CONCLUSION: based on the findings of fact, testimony and materials presented at the public hearing, we therefore conclude that the granting of the special use permit, as submitted, would-be in harmony with the general purposes and intent of the Zoning Ordinance and Comprehensive Plan. Resolution No. 152-90 1 of 2 BE IT RESOLVED, that the Planning Commission of the City of Port Orchard hereby requests that the City Council approve the special use permit, as submitted, subject to the following conditions: 1. The Department of Fisheries shall issue the hydraulic application permit prior to any excavation of the property. 2.
