1483 - Resolution - Procedures to Enhance View from Private PropertiesRESOLUTION NO. 1483 V A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,. ESTABLISHING PROCEDURES TO ENHANCE THE VIEW FROM PRIVATE PROPERTIES. WHEREAS, the view from a parcel of property enhances the value of that property, and WHEREAS, as vegetation continues to grow unabated, the view from various parcels of property is degraded. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, HEREBY RESOLVES AND ESTABLISHES THE FOLLOWING: Property owners may petition the City Council to assist in removing or trimming trees and shrubs which degrade the view from private property. The City Council may accept or reject the petition. The City Council will reject the petition if the owner of the trees and shrubs has not signed the document. Upon acceptance of the petition, the City Council may authorize the City Engineer to contract with a firm to improve the view as requested by the petitioners. The City shall be added as a Named Insured on the contractor's insurance policy. The contractor shall be compensated by the City. Prior to the City signing a contract with the firm to trim the vegetation, the petitioners will sign an agreement with the City. In this agreement, the total cost of the work, the cost to the City per parcel of property and a description of the work shall be specified. The City shall pay the cost of cutting vegetation within the right of way. Clean up and .utilization of the wood will be specified in the contract. Before the City contracts with a firm to complete the work, all property owners as specified in the contract shall pay the City the required amount. Before any shrub or tree will be cut, the owner of, the vegetation will mark it with a ribbon in order to minimize - the chance of cutting the wrong tree or shrub. The owner of the vegetation may waive this requirement to mark the vegetation if he or she so desires.
