1388 - Resolution - Quit Claim Deed SR16 Tremont Street InterchangeRESOLUTION NO. 1388 V A RESOLUTION OF THE CITY OF PORT ORCHARD AUTHORIZING THE MAYOR TO EXECUTE QUIT CLAIM DEED RELATIVE TO MATTERS OF STATE ROUTE 16 - TREMONT STREET INTERCHANGE. WHEREAS, the City of Port Orchard is the record owner of the hereinafter described real estate; WHEREAS, in the improvement of SR 16, Tremont Street Interchange by the State of Washington, Department of Transporta- tion, it is necessary and advisable for the State of Washington to acquire title to the following described tracts of land: TRACT I: All that portion of the following described Parcel "A" which lies between lines number 1 and 2 each as described herein: LINE 1: Beginning at a point opposite Highway Engineer's Station (hereinafter referred to as HES) Alder Road 109+00 = WE 109+00 on the WE survey line of SR 16, Tremont Street Interchange and 30 feet Northwesterly therefrom; thence Southeasterly to a point opposite said HES and 30 feet South- easterly therefrom; thence Northeasterly parallel with said survey line"to a point opposite HES WE 110+00; thence North- easterly to a point opposite HES WE 112+00 and 70 feet South- easterly therefrom; thence Northeasterly to a point opposite HES WE 116+00 and 60 feet Southerly therefrom; thence South- easterly to a point opposite HES 121+00 on the survey line of said highway and 95 feet Southerly therefrom; thence South- easterly to a point opposite HES 123+00 and 85 feet Southerly therefrom. LINE 2: Beginning at a point opposite HES Alder Road 117+00 on the Alder Road survey line of SR 16, Tremont Street Inter- change and 30 fe.et Northwesterly therefrom; thence Southeasterly to a point opposite HES WE 116+00 on the WE survey line of said highway and 140 feet Northerly therefrom; thence Easterly to a point opposite HES WE 117+00 and 140 feet Northerly there- from; thence Southeasterly to a point opposite HES WE 121+00 and 100 feet Northerly therefrom; thence Southeasterly to a point opposite HES WE 124+00 and 90 feet Northerly therefrom. TRACT II: All that portion of the following described Parcel "A" lying in a strip of land 90 feet wide lying Southeasterly of and contiguous to the survey line of Alder Road and between lines extended Southeasterly at right angles and or radially from HES Alder Road 122+20 and HES Alder Road 124+27.49 on the Alder Road survey line of SR 16, Tremont Street Interchange. PARCEL "A": That portion of the Southeast Quarter of the Southwest Quarter, Section 34, Township 24 North, Rang.e 1 East, W.M., in Kitsap County, Washington, lying East of County Road EXCEPT County Road; AND EXCEPT that portion thereof conveyed to Kitsap County by deed recorded under Auditor's File No. 959191, more parti- cularly described as follows: Beginning at the South Quarter corner of said Section 34; thence along the South line of said Section 34, North 88°17'27" West 369.05 feet to the true point of beginning; thence North 88°17'27" West 760.00 feet to the Easterly margin of Old Clifton Road; thence along said margin, North 22°55'10" East 712.72 feet to the beginning of a curve to the right having a radius of 686.20 feet; thence 38.50 feet along the arc of said curve through a central angle of 3012'54";thence South 88017'27" East 477.04 feet; thence along a line parallel with the North -South centerline of said Section 34, South 0°52'34" West 700.00 feet to the true point of beginning; EXCEPT the South 30 feet thereof. WHEREAS, after due consideration by the City Council of the City of Port Orchard, it appears to the said Council that i.t will be for the best interests of both City of Port Orchard and the State of Washington that City of Port Orchard convey said lands to the State of Washington by Quit Claim Deed for a consideration of THIRTY EIGHT THOUSAND FOUR HUNDRED AND SIXTY AND NO/100---- ($38,460.00) ---- Dollars. .NOW THEREFORE, be it hereby RESOLVED by the City Council of the City of Port Orchard, Washington that the City of Port Orchard in accordance with RCW 47.12.040 and through its Mayor do execute and deliver said deed to the State of Washington, Department of Transportation.
