A RESOLUTION OF THE CITY OF PORT ORCHARD
AUTHORIZING THE MAYOR TO SIGN CONTRACT
REGARDING PORT ORCHARD/KITSAP COUNTY
SEWER DISTRICT #5 WASTEWATER FACILTIES
CONSTRUCTION MANAGEMENT SERVICES
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD
DOES HEREBY RESOLVE:
THAT: The Mayor of the City of Port Orchard
be and hereby is authorized to sign contract regarding
Construction Management Services for the Port Orchard/
Sewer District #5 Wastewater Facilities Improvement
Construction Project. (copy attached)
PASSED by the City Council and APPROVED by the

CONTRACT REGARDING
CONSTRUCTION MANAGEMENT SERVICES
Section 1. Scope of Services. The City of Port Orchard shall
hire Mr. Mel Holgerson (hereinafter Holgerson) to provide the following
construction management services as requested by the City Engineer on
the Port Orchard/Sewer District #5 Wastewater Facilities Improvements.
Acting as an agent of the City Holgerson shall:
a) Observe, inspect and monitor the performance of Kramer, Chin
and Mayo Inc. to assure proper coordination between the State
agencies, the City, the various Contractors and Kramer, Chin
and Mayo, Inc..
1?) Coordinate with and respond to all requests from the Department
of Ecology.

c) Interpret plans and specifications.
d) Review shop drawings, diagrams, inspection results and other
technical documents, if necessary, to determine if such comply
with contract requirements.
e) Maintain and provide daily reports of activities.
f) Provide other construction management services as requested -
by the City Engineer.
Section 2. Payment. The City shall pay and provide Holgerson
with the following:
a) $19.00 per hour and an additional $9.50 per hour for each hour
worked in excess of eight per day; Provided, overtime must
be approved in advance by the City Engineer
b) Payment of workman's compensation coverage.
c) Payment of the State of Washington travel mileage allowance
for the use of Holgerson's private automobile while on-the-job.
At this time, the State travel milage allowance is 18.5 cents
per mile.
(1) Clerical services thru either the City or a specialized firm,
exluding filing. Filing will he done be Holgerson if necessary.
e) An office and overhead expense approved by the Citv.
f) In regard to the administration of the Wastewater Facility
contract, the City shall include Iolgerson in its current
blanket insurance coverage and provide Holgerson all. protection
normally afforded a City employee.
On a weekly basis, Holgerson 'shall submit a statement to the
City Engineer indicating hours worked and expenses incurred.
On a weekly basis, Holgerson will provide a schedule of anticipated
work hours of the next week to the City Engineer. Holgerson shall.
work a minimum of four hours per workday and a maximum of eight hours
per workday unless otherwise approved by the City Engineer.
Section 3. Independent contractor relationship. The parties
recognize that the relationship of Holgerson to City is that of an
independent contractor. City shall provide no fringe benefits to
Holgerson and Holgerson shall be responsible for his own federal taxes
and FICA.
Section 4. Hold Harmless. Holgerson shall hold harmless and
defend the City, its agents, officers, and employees, from any and all
suits or claims for injuries or claims for injuries or damages, including
attorney's fees, arising out of Mr. Holgerson's performance of this
contract.
Section 5. Termination.
This contract may be terminated by
either party upon ten (10) days written notice.
