ORDINANCE NO. 1759 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING ORDINANCE NO. 1632 AND ORDINANCE NO, 1739 MODIFYING LAND USE CONDITION NO. 38 REGARDING PLAYGROUND EQUIPMENT LOCATED AT AIDAN PLACE SUBDIVISION. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Tax Account No: 252401-4-009-2001 and 252401-4-023-2001 LEGAL DESCRIPTION: Portion of the south half of the Northeast quarter of the Southeast Quarter of Section 25, Township 24 North, Range 1 East, W.M., Kitsap County, Washington, lying westerly of Olney Avenue; except portion deeded to Richard V. Krueger and Helen Krueger, husband and wife, by auditor's file number 486008, recorded in volume 482 on page 673, records of Kitsap County. WHEREAS, Ordinance No. 1632 approved a Preliminary Plat as submitted by Jim James for Aidan Place Subdivision with 48 conditions, and WHEREAS, the City Council of the City of Port Orchard held Public Hearings on August 24, 1998 and September 28, 1998 to hear testimony and public input on the requested modification of Condition Nos. 24 and 26, of Ordinance No. 1632 which requires the developer to provide for sidewalks, and requirements for the cross section of the road pavement, and WHEREAS, the City Council of the City of Port Orchard held a Public Hearing on February 22, 1999 to hear testimony and public input on the request to delay the playground installation until people are living in and around the playground, and WHEREAS, the City Council of the City of Port Orchard concluded that granting this modification would not be detrimental to the health, safety, morals and general welfare of the community, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: read as follows: That Condition No. 38 of Ordinance No. 1632 and Ordinance No. 1739 is hereby modified to 38. By the time ten homes in the subdivision are occupied, the developer shall install a playground area owned and maintained by the homeowners association. It shall consist of a big toy, such as a swing set, jungle gym, or other equipment and shail have an impact resistant surface, to the approval of the City Engineer. Otherwise, no further building permits will be issued for this subdivision until the playground is constructed and has City approval.
