ORDINANCE
The following is a summary of an Ordinance approved by the Port Orchard City Council at their
regular Council meeting held October 25, 1999.
ORDINANCE NO. 1771
AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, REGULATING ACTIVITIES ON CITY OWNED
PIERS AND DOCKS, AND REPEALING ORDINANCE NO. 1631.
Copies of Ordinance No. 1771 are available for review at the office of the City
Clerk of the City of Port Orchard. Upon written request a statement of the full text
of the Ordinance will be mailed to any interested person without charge. Thirty
days after publication, copies of Ordinance No. 1771 will be provided at a nominal
charge.

ORDINANCE NO.1771
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
REGULATING ACTIVITIES ON CITY OWNED PIERS AND DOCKS, AND
REPEALING ORDINANCE NO. 1631.
WHEREAS, the City of Port Orchard has constructed piers, docks and ramps for public
access to the water; and
WHEREAS, the purpose of these improvements is to enhance the recreational use of
Sinclair Inlet; and
WHEREAS, the improvements are not illuminated for night use, now, therefore
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. There shall be no commercial activity on the DeKalb Street Pedestrian Pier or
the Water Street Boat Launch. Commercial activity is defined as, but not limited to, loading or unloading
cargo from commercial fishing boats, repair of commercial watercraft and repairing, maintaining or drying of
fishing nets, and loading or unloading commercial cargo, to include logs or merchandise.
SECTION 2. There shall be no moorage at the DeKalb Street Pedestrian Pier between the
hours of 11:00 PM and 6:00 AM.
SECTION 3. Moorage at the Water Street Boat Launch shall be limited to 15 minutes.
SECTION 4. THE City Council may authorize exemptions to the above restrictions, if the
permitted action does not unduly prevent other people from using the facility. An exemption may be obtained
by submitting a written request to the City Clerk's office citing the specific reasons for the request. The
written requestwill be considered by the City Council at a regularly scheduled meeting.
SECTION 5. Any person, firm or corporation violating any of the provisions of this ordinance
shall, upon conviction thereof, be guilty of a"misdemeanor and be punished by a fine in any sum not
exceeding one hundred dollars.
SECTION 6. Validity. The invalidity or unconstitutionality of any provision or section
of this ordinance shall not render any other provision or section of this ordinance invalid or
unconstitutional.
SECTION 7. Repealer. Ordinance No. 1631 is hereby repealed in its entirety.
SECTION 8. Savings Clause. Ordinance No. 1631, which has been repealed by this
ordinance, shall remain in force and effect until the effective date of this ordinance.
