1772 - Ordinance - Subdivision at Bravo Terrace and Sedgwick Roadi NOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held October 25, 1999. ORDINANCE NO. 1772 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, APPROVING A SUBDIVISION FOR A COMMERCIAL DEVELOPMENT OF 12 LOTS LOCATED AT BRAVO TERRACE AND SEDGWICK ROAD, AS SUBMITTED BY ROBERT AND GLORIA ROLAND AND HOWARD ROLAND, OWNERS AND APPLICANTS. Copies of Ordinance No. 1772 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Thirty days after publication, copies of Ordinance No. 1772 will be provided at a nominal charge. Complete legals see - ATTACHMENT "A" TAX ACCOUNT NOS: 112301-2-037-2008; 112301-2-038-2007; 112301-2-042-2001; 112301-2-043-2000; 112301-2-044-2009; 112301-2-040-2003;112301-2-035-2000012301-2-036-2009; 112301-2-045-2008 WHEREAS, Robert and Gloria Roland and Howard Roland, owners and applicants, have submitted an application for a preliminary plat to allow a subdivision for a commercial development of 12 lots located at Bravo Terrace and Sedgwick Road, and WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard, Washington a copy of their Resolution No. 302-99, recommending approval of said petition, and WHEREAS, the Council of the City of Port Orchard did hold a Public Hearing on October 11, 1999 to hear testimony of fact and conclusion as follows: FINDING OF FACT: The use requested is compatible with other uses in the area. The proposed use is a permitted use within Commercial Zone. CONCLUSION: Based on testimony, materials presented and findings of fact, the Port Orchard City Council does hereby conclude that approving this preliminary plat would not be detrimental to the health, safety, morals and general welfare of the community now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: The Application for Preliminary Plat approving a subdivision for a commercial development of 12 lots located at Bravo Terrace and Sedgwick Road is approved with the following 13 conditions: Ordinance No. 1772 Page 2 of 2 No permanent signs shall be erected without prior approval from the Planning Department and issuance of a building permit. 2. All landscaping shall comply with City standards and be completed before Final Certificate of Occupancy. 3. Tracts B and D shall be dedicated as open space, as indicated on the preliminary plat. 4. The project shall comply with the fire flow requirements, as specified by the Fire Marshall. 5. All water system improvements will be complete, and the as -built drawing will be accepted by the City prior to Final Plat approval. 6. All sewer system improvements will be complete, and the as -built drawings accepted by the City prior to Final Plat approval. Prior to Final Plat approval, the McDonald's Restaurant shall install a new grease trap/interceptor, as approved by the Building Department. 8. The streets shall be dedicated to the City as public right-of-way. 9. Any deviation of the street standards would have to be approved by the City Council. 10. All stormwater system improvements will be completed prior to approval of the Final Plat. 11. The stormwater pond shall be owned and maintained by the applicant. 12. All lots will be surveyed and recorded. 13. All utilities will be underground.
