Tax Account No. 342401-4-075-20 LEGAL DESCRIPTION: Section 34, Township 24, Range 1 E, Parcel #4 Complete Legal Description: Attachment "A" WHEREAS, the Port Orchard City Council did on March 8, 1993 approve Ordinance No. 1572 to reclassify property located in the 400 block of Tremont Street West; East of SR16, between Tremont Street and Pottery Avenue from Residential High to Commercial General and Multi -family 20 to allow site development of mixed land uses with twenty-four (24) conditions; and WHEREAS, condition No. 1 specified the project is to be treated as a site specific plan; �. WHEREAS, the Council of the City of Port Orchard did hold a Public Hearing June 14 and June 28, 1993, adopting Ordinance No. 1586 authorizing the realignment of commercial use property lines within the South Kitsap Health Care Campus, and WHEREAS, the Council of the City of Port Orchard did hold a Public Hearing on April 25, 1994 adopting Ordinance no. 1604 allowing the use of six or seven foot street trees instead of eight foot street trees and delete the ornamental paving at the intersections within the health care campus, and WHEREAS, the Council of the City of Port Orchard did hold a Public Hearing on June 13, 1994 adopting Ordinance No. 1609 allowing the use of 8 foot wide crosswalk delineation pavers at the boulevard intersections. within the Health Care Campus, and WHEREAS, Morningview Care, applicant, on behalf of Harrison Hospital, subsequently has submitted an application for a site plan revision for the South Kitsap Health Care Campus, requesting a modification to the site plan from a 2-story 24,000 square foot professional office building to a 1-story Alzheimer residential care facility. Phase I would consist of a 41 bed, 27-unit facility. Phase II would allow for an expansion of up to 22 additional beds, and WHEREAS, the Council of the City of Port Orchard did hold a Public Hearing on September 28, 1998 to hear testimony of fact and conclusion as follows: Ordinance No. 1737 Page 2 of 3 FINDINGS OF FACT: (1) Subject site is adjacent to Pottery Avenue and is visible from Tremont Street. The Tremont Corridor Specific Plan was adopted (Resolution No. 1615) to be used in the guidance of future development along Tremont Street. (2) The Harrison Hospital Site Plan originally approved a 2-story 24,000 square foot professional office building. The Harrison Hospital Site Plan is site plan specific. (3) The proposed site plan revisions do not change any permitted uses within Commercial General and Multiple Family 20 Zoning Designations. CONCLUSION: Based on testimony, materials presented and findings of fact, the Port Orchard City Council does hereby conclude that (1) revisions to the site plan would not be detrimental to the health, safety, morals and general welfare of the community; and (2) it is in the best interest of the community to allow revision of the site plan from a 2-story 24,000 square foot professional office building to a 1-story Alzheimer residential care facility. Phase 1 would consist of a 41 bed, 2-unit facility. Phase II would allow for an expansion of up to 22 additional beds, within the Health Care Campus, now, therefore, THE COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS: That the Health Care Campus site plan, as submitted by Moringview Care, on behalf of Harrison Hospital hereby approves the original 24 Conditions of Approval as adopted in Ordinance No. 1609 and further approves the following 7 Conditions of Approval for the Morniview Care Alzheimer facility located at 300 South Kitsap Boulevard: 1. Phase I is not to exceed 17,000 square feet, 41 beds and 27 units. Phase II is not to exceed 2,200 square feet and 22 beds. Approval is site plan specific and any major modifications must be reviewed and approved by the City Council. 2. A building permit is required. The Fire Department must review and approve the building plans. Landscaping, lighting, and irrigation plans must be approved prior to building permit issuance and installed prior to certificate of occupancy. 3. A crosswalk must be installed at the south edge of the Pottery Avenue and South Kitsap Boulevard intersection prior to issuance of the certificate of occupancy. The crosswalk is to be established with thermoplastic paint with a "ladder" or "block" design, in lieu of two parallel lines. 4. A written determination by a qualified engineer must be submitted to the Public Works Department prior to building permit issuance that the existing stormwater system can accommodate this project. 5. A detailed plan to prevent wandering must be submitted to the Port Orchard Police Chief for review and approval prior to issuance of the certificate of occupancy. 6. Parking for Phase I and II will be based on .5 space per unit, which equals a total 25 parking spaces. Phase II parking must be installed simultaneous to Phase I parking. The dumpster area must be moved to a less obvious area approved by the City Planner and must be enclosed with a six (6) foot tall sight obscuring fence.
