1600 - Ordinance - Amending Ordinance 1537 Ross Creek ProjectORDINANCE NO. 1600 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING ORDINANCE NO. 1537 BY MODIFYING CONDITION NO. 22 WHICH REQUIRED ROAD IMPROVEMENTS NEAR THE INTERSECTION OF SHERMAN AVENUE AND MELCHER STREET BY THE HIGHLANDS AT ROSS CREEK PROJECT, TYEE SINCLAIR, OWNER OF RECORD. WHEREAS, Ordinance No. 1537 approved a land use reclassification for the Highlands at Ross Creek Project with twenty-eight conditions, and WHEREAS, Tyee Sinclair, subsequently petitioned the City Council of the City of Port Orchard for modification of Condition No. 22, and WHEREAS, the City Council of the City of Port Orchard held a public hearing on January 14, 1994 to hear testimony and public input on the requested modification of Condition No. 22 which requires road improvements near the intersection of Sherman Avenue and Melcher Street, and WHEREAS, the City Council of the City of Port Orchard concluded that granting this modification would not be detrimental to the health, safety, morals and general welfare of the community. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: follows: That Condition No. 22 of Ordinance No. 1537 is hereby amended to read as 22. Each house in the Highlands at Ross Creek shall pay the City of Port Orchard $400 at the time a building permit is issued for the improvement of the public right of ways of Pottery Avenue and/or Melcher Street. This payment will not be required if Kitsap County has charged and received a road impact fee in excess of $400 for the house to be permitted.
