AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
ADOPTING THE WASHINGTON MODEL TRAFFIC ORDINANCE (MTO) AS
CONTAINED IN THE WASHINGTON ADMINISTRATIVE CODE, CHAPTER
308-330 WAC, TO REGULATE TRAFFIC IN THE CITY OF PORT ORCHARD
AND REPEALING ORDINANCE NO. 1565.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. ADOPTION BY REFERENCE. The "Washington Model Traffic
Ordinance", Chapter 308-330 WAC, is hereby adopted by reference as the traffic ordinance
of the City of Port Orchard as is set forth in full herein.
SECTION 2. ADDITIONAL PROVISIONS ADOPTED. The following sections of
Washington Administrative Code (WAC) and the Revised Code of Washington (RCW) are hereby
adopted by reference, with any amendments thereto, and is included in the traffic
ordinance of this City as if fully set forth herein: RCW 46.20.710, RCW 46.20,720, RCW
46.20.730, RCW 46.20.740 and Sections 4, 5, 6, 7, 10, 11, 12, and 23 of Chapter 275,
Laws of 1994 known as the 1994 Omnibus Drunk Driving Act.
SECTION 3. SECTIONS NOT ADOPTED. The following sections of the Washington
Model Traffic Ordinance are not adopted by reference and are expressly deleted:
WAC 308-330-250, WAC 308-330-275, WAC 308-330-375, WAC 308-330-500, WAC 308-330-505,
WAC 308-330-510, WAC 308-330-515, WAC 308-330-520, WAC 308-330-525, WAC 308-330-530,
WAC 308-330-535, WAC 308-330-540, WAC 308-330-825, RCW 46.44.090, RCW 46.44.091, RCW
46.44.092, RCW 46.44.093, RCW 46.44.095, RCW 46.44.096, RCW 46.44.120, RCW 46.44.130,
RCW 46.44.140.
SECTION 4. REPEAL. Ordinance No. 1565 is hereby repealed.
SECTION S. SAVINGS CLAUSE. The repeal of Ordinance No. 1565 does not
effect any pending litigation or existing litigation and does not act as an abatement
or bar to any action or proceeding pending under or by virtue of the repealed ordinance.
SECTION 6. SEVERABILITY CLAUSE. If any provision of this ordinance or
its application to any person or circumstance is held invalid, the remainder of this
ordinance, or the application of the provision to other persons or circumstances is not
affected.
SECTION 7. EFFECTIVE DATE. This ordinance shall take effect from and
after July 1, 1994.

AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
REPEALING ORDINANCE NO.1565ANDADOPTING THE WASHINGTON
MODEL TRAFFIC ORDINANCE (MTO) AS CONTAINED IN THE
WASHINGTON ADMINISTRATIVE CODE, CHAPTER 306-330 WAC, TO
REGULATE TRAFFIC IN THE CITY OF PORT ORCHARD.
Copies of Ordinance No. 1605 are available for review at the office of the City Clerk of the
City of Port Orchard. Upon written request a statement of the full text of the Ordinance will
be mailed to any interested person without charge. Thirty days after publication, copies of
Ordinance No, 1605 will be provided at a nominal charge.
