1616 - Ordinance - Amending Ordinance 1469 ZoningORDINANCE NO. 1616 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1469; BY AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING 2.5 ACRES OF PROPERTY LOCATED IN THE 1300 BLOCK OF LLOYD PARKWAY, (City of Port Orchard, applicant). WHEREAS, City of Port Orchard, applicant has petitioned a zoning ordinance amendment, requesting reclassification of 2.5 acres of property located in the 1300 block of Lloyd Parkway, and i WHEREAS, The City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard, Washington a copy of their Resolution No. 224-94- ATTACHMENT "A" recommending approval of said petition, and WHEREAS, The Council of the City of Port Orchard did hold a Public Hearing on October 10, 1994 to hear testimony of fact and conclusion as follows: FINDINGS OF FACT: The use requested is compatible with other uses in area. The proposed use is a permitted use within Public Property. CONCLUSION: Based on testimony, materials presented and findings of fact, the Port Orchard City Council does hereby conclude that granting this zone reclassification would not be detrimental to the health, safety, morals and general welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON THAT: The Council of the City of Port Orchard does hereby adopt Planning Commission Resolution No. 224-94 with Findings of Facts, as their own and does hereby reclassify certain property from Industrial to Public Property to allow a work release facility, with the following eight conditions: 1. Coverage, including buildings, parking areas, driveways, and walkways, shall occupy no more than seventy percent (70%) of the total lot area. 2. A lighting plan shall be submitted and approved prior to placement of outdoor illumination. 3. A building permit shall be obtained prior to the beginning of any construction or demolition work on site. No building permit shall be issued without concurrence from the Kitsap County Health District. 4. All new landscaping shall be maintained and any dead or diseased landscaping within one year of occupancy shall be replaced. Ordinance No. 1616 Page Two of Two 5. No development shall be designed that would impede access to the water reservoir and pistol range. 6. The Facility will be connected to the City of Port Orchard sanitary sewer system. 7. The Facility will have a minimum of 16 parking spaces. 8. The reclassification shall be valid for a period of eighteen (18) months. If substantial progress toward construction has not occurred at the expiration of this time period, the City Council may revoke the new land use reclassification or approve an eighteen (18) month extension with conditions. LEGAL DESCRIPTION: SEE EXHIBIT A. WHEREAS, a Public Hearing was held on Monday, 19 September 1994, and the Planning Commission considered the findings and facts of the proposal, testimony, and materials presented at the Hearing; and WHEREAS, the applicants requested a Reclassification from Industrial to Public Property to allow the placement of a work release facility on no more thtan 2.50 acres of land; and WHEREAS, the Planning Commission considered the specific use proposed to be appropriate as conditioned; and WHEREAS, the proposed use, as demonstrated in supporting documentation provided by the applicant will not be detrimental to the public health, safety, welfare or injurious to property and improvements in the vicinity and therefore will be in conformance with the objectives of the Comprehensive Plan. WE THEREFORE FIND: that the proposed reclassification from Industrial to Public Property is compatible with the surrounding land uses and will not have a detrimental effect on the surrounding community. CONCLUSION, based on the facts, testimony, and materials presented at the Hearing, we therefore conclude that the Reclassification from Industrial to Public Property to allow the placement of a work release facility on no more than 2.50 acres of land is in harmony with the general purposes of the Zoning Ordinance and the Comprehensive Plan.
