AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, Y
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1469; CHAPTER
14(A) AND CHAPTER 15 (A AND B) RELATING TO DECRIMINALIZING
VIOLATIONS OF SAID ORDINANCE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ORCHARD, WASHINGTON, AS FOLLOWS:
SECTION I. That Ordinance No. 1469 (Zoning Ordinance) Chapter 14,
(A) shall be amended to read as follows:
A. ENFORCEMENT It shall be the duty of the City Engineer or his
designee to see this Ordinance and amendments thereto codified as the Port Orchard
Zoning Ordinance enforced through proper legal channels. No permit for the
construction or alteration of any building or part thereof shall be issued unless
the plans, specifications and intended use of such building conform to all respects
to the Port Orchard Zoning Ordinance.
SECTION II That Ordinance No. 1469 (Zoning Ordinance) Chapter 15 (A)
shall be amended to read as follows:
A. VIOLATION It shall be unlawful and a violation of this
Ordinance and amendments thereto codified as the Port Orchard Zoning Ordinance for
any person to use, construct or occupy any portion of any premises in violation of
the provisions of the Port Orchard Zoning Ordinance, until such unlawful use has
ceased and such unlawful construction and equipment has been removed.
SECTION III That Ordinance No. 1469 (Zoning Ordinance) Chapter 15
(B) shall be amended -To -read as follows:
B. PENALTY Any responsible person, firm, corporation or agent
who violates, disobeys, omits neglects or refuses to comply with any of the
provisions of the Port Orchard Zoning Ordinance shall be deemed guilty of a civil
infraction. Each five calendar day period that a violation exists constitutes a
separate offense.
PASSED by the City Council of the City of Port Orchard, APPROVED by the
Mayor and attested by the Clerk in authentication of such passage this 14th day of
November, 1994.
