1421 - Ordinance - Amending ZoningORDINANCE NO. 1421 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1153; BY AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING CERTAIN PROPERTY (Puget Power, owner of record) LOCATED AT 1430 RETSIL ROAD WHEREAS, Puget Power, owner of record, has petitioned a zoning ordinance amendment, requesting reclassification of property located at 1430 Retsil Road, as described in said petition, and WHEREAS, The City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard, Washington a copy of their Resolution No. 93-88 recommending approval of said petition, and WHEREAS, The Council of the City of Port Orchard did hold a Public Hearing on April 11, 1988 to hear testimony of fact and conclusion as follows: NOW, THEREFORE, be it ordained that the Council of the City of Port Orchard, Washington does hereby adopt Planning Commission Resolution No. 93-88 with Findings of Facts and recommended conditions (Resolution No. 93-88 available in City Clerk's Office) as their own and does hereby reclassify certain property located at 1430 Retsil Road from Residential Low to Industrial. LEGAL DESCRIPTION: THAT PORTION OF THE NORTH 112, SW 114 OF SE 114, SECTION 25, TOWNSHIP 24 NORTH, RANGE I EAST, W.M., LYING WESTERLY OF COUNTY ROAD NO. 349 (RETSIL ROAD), EXCEPT THEREFROM THE NORTH 25 FEET, AND EXCEPT THEREFROM THE WESTERLY 140 FEET; BEING SITUATED IN KITSAP COUNTY, STATE OF WASHINGTON. WHEREAS, Puget Power & Light Company has requested a zone reclassification for their property located 1430 Retsil Road, from Residential -Low to Industrial, in order to bring the zoning into conformance with the existing use and the Comprehensive Plan, and WHEREAS, a public hearing was held on 21 March 1988 and that the Planning Commission considered the findings of facts, the testimony and material presented at the hearing, and WHEREAS, the City's Comprehensive Plan map designation for the property is Industrial, and WHEREAS, A SEPA checklist has been submitted and has received a declaration of non -significance, and WHEREAS, the utility service center operation has been in existence for many years and can be considered as a legal non -conforming use under the present City zoning designation, and WHEREAS, the continuation of the existing utility service center plus the proposed improvements will not create a significant impact on the existing transportation system and/or surrounding uses. WE THEREFORE FIND: The proposal as presented meets all the requirements of the zoning ordinance for the industrial district and would be in harmony with the general purposes and intent of comprehensive plan. CONCLUSION: Based on the findings of facts, the testimony and materials presented at the public hearing, we therefore conclude that bringing the existing use into conformance with the zoning ordinance has as its purpose the improvement of the area for public good and is the most appropriate zone classification for the above described property. BE IT RESOLVED, that the Planning Commission of the City of Port Orchard hereby respectfully requests that the City Council approve the zone reclassification to Industrial, as requested.
