1436 - Ordinance - Amending Comp PlanORDINANCE NO. 1436 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO. 895; BY AMENDING THE COMPREHENSIVE PLAN MAP CERTAIN PROPERTIES THEREIN THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES ORDAIN AS FOLLOWS: WHEREAS, Gary P. Wasilchen, owners of record, have initiated a comprehensive plan ordinance amendment requesting redesignation of property described in said petition, and all legal requirements have been performed; and WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard their findings and recommendations (ATTACHMENT "A") NOW, THEREFORE, BE IT ORDAINED, that the City Council of the City of Port Orchard does hereby adopt the findings and recommendations of the Port Orchard Planning Commission as it's own and does hereby redesignate certain property on the Comprehensive Plan Map from Kitsap County designation of Residential -Low to City of Port Orchard Commercial General. WASILCHEN FOR THE NORTHEAST CORNER OF TREMONT STREET & PORT ORCHARD BOULEVARD. LEGAL DESCRIPTION: Lot 6 through 25, Block 2 and Lots 10 through 25, Block 1 of the Plat of Harrison Park Addition to Sidney, EXCEPT ROADS, Port Orchard, Washington. WHEREAS, Gary P. Wasilchen has requested a change in the Comprehensive Plan designation of his property at 195 Tremont, from residential -low to commercial general, in order to be allowed to construct a mini -warehouse complex including a managers residence and a small pipe repair shop, and WHEREAS, a public hearing was held on 19 September 1988 and that the Planning Commission considered the findings of facts, the testimony and material presented at the hearing, and WHEREAS, a SEPA checklist has been submitted and has received a declaration of non -significance, and WHEREAS, traffic impact, on the existing roadway system, will be minimal from the proposed project, and WHEREAS, the proposed use is compatible with existing uses within the neighborhood, and WHEREAS, ultimately areas along the Port Orchard Bypass route will be commercial. WE THEREFORE FIND: that due to the the increase in traffic, the areas along Port Orchard Bypass route are no longer conducive to residential development, that the proposed change in the Comprehensive Plan designation to Commercial General is is in the public interest, and will not be detrimental to existing uses. CONCLUSION: Based on the findings of facts, the testimony and materials presented at the public hearing, we therefore conclude that a change in the Comprehensive Plan Map, as requested, to be in harmony with the general purposes and intent of the Zoning Ordinance and Comprehensive Plan. BE IT RESOLVED, that the Planning Commission of the City of Port Orchard hereby respectfully requests that the City Council approve a change in the Comprehensive Plan map designation of Residential -High to Commercial General, as requested, for the northeast corner of Port Orchard Boulevard & Tremont Street. Jon Ilo<anson, C auman ATTEST: Ruth Strube, Secretary SUMMARY OF CITY OF PORT ORCHARD ORDINANCE NO. 1435 ADOPTING THE FLOOD DAMAGE PREVENTION PLAN AND AUTHORIZING FINDINGS OF FACT, PURPOSE AND OBJECTIVES. Section 1 of Ordinance No. 1435 provides statutory authorization, Findings of Fact, Purpose and Objectives. Section 2 of Ordinance No. 1435 adopts definitions for interpretation and the enforcement of the Flood Damage Prevention Plan. Section 3 of Ordinance No. 1435 provides general provisions identifying lands to which this ordinance applies and the basis for establishing the areas of Special Flood Hazard. Section 4 of Ordinance No. 1435 provides (4.1) the administration of Development Permits; (4.2) designates the City Engineer as the administrative officer, (4.3) establishes the duties and responsibilities of the City Engineer as the administrative officer (4.4) establishes procedure for variance from this ordinance. Section 5 of Ordinance No. 1435 provides provisions for Flood Hazard Reduction (5.1) general standards such as anchoring, construction materials and methods, utilities, and subdivision proposals and review of building permits; (5.2) Specific Standards, such as residential construction, non-residential construction, manufactured homes; (5.3) Floodway, provides provisions for restricting encroachments into flood hazard areas. (5.4) Wetlands Management, establishes process to avoid short and long term adverse impacts associated with the destruction or modification of wetlands. Copies of Ordinance No. 1435 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Thirty days after publication, copies of Ordinance No. 1435 will be provided at a nominal charge.
