1406 - Ordinance - Amending Ordinance No. 895 Comp Plan MapORDINANCE NO. 1406+/ AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO. 895; BY AMENDING THE COMPREHENSIVE PLAN MAP CERTAIN PROPERTIES THEREIN THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES ORDAIN AS FOLLOWS: WHEREAS, W.E. Lumsden and Chuck Childress, et al, owners of record, have initiated a comprehensive plan ordinance amendment requesting redesignation of property described in said petition, and all legal requirements have been performed; and WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard their findings and recommendations (Attachment "A") that the Comprehensive Plan Map be amended for the reasons stated therein; NOW, THEREFORE, BE IT ORDAINED, that the City Council of the City of Port Orchard does hereby adopt the findings and recommendations of the Port Orchard Planning Commission as it's own and does hereby redesignate certain property on the Comprehensive Plan Map from Kitsap County designation of Semi -Rural to Industrial. LEGAL DESCRIPTION: Section 34, Township 24 North, Range 01 East; the NW 1/4 of the SW 1/4 Section 34, except the West 225 feet thereof and except the North 30 feet of said NW 1/4, SW 1/4; together with the South 1/2 of the NE 1/4 of the SW 1/4 and that portion of the NE 1/4, SE 1/4 lying Westerly of State Highway #16, except road. Ordinance No. 1406 CITY OF PORT ORCHARD PLANNING COMMISSION RESOLUTION NO. 85-87 A RESOLUTION BY THE PORT ORCHARD PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL DESIG14ATE THE BELOW DESCRIBED PROPERTY "INDUSTRIAL" ON THE COMPREHENSIVE PLAIT, SIMULTANEOUSLY WITH THE ACCEPTANCE OF THE ANNEXATION PETITION, SUBMITTED BY LUMSDEN, SHEARER, HASELWOOD AND CHILDRESS. WHEREAS, The City of Port Orchard has received a Notice of Intent to Petition for Annexation. As a condition of acceptance'of this annexation petition, the City Council is requiring the simultan- eous adoption of a Comprehensive Plan Designation for the subject property, and WHEREAS, a SEPA checklist has been submitted and has received a declaration of non -significance, and WHEREAS, the property owners have requested that their property be designated "Industrial" on the Comprehensive Plan map, and WHEREAS, a public hearing was held on 21 September 1987 and that the Planning Commission considered the findings of facts, the testimony and material presented at the hearing, and WHEREAS, the existing gravel pit operation has been in operation for many years, and WHEREAS the gravel pit operation, office, shop and contractor's storage yard have been granted unclassified use permits from the County. WE THEREFORE FIND: that the most compatible and suitable zoning designation on the Comprehensive Plan map for the above described property to be for "Industrial" because of the traditional and existing uses. CONCLUSION: Based on the findings of facts, the testimony and materials presented at the public hearing, we therefore conclude that a designation of Industrial, would be in harmony with the general purposes and intent of the zoning ordinance and comprehensive plan. 1
