1320 - Ordinance - Charges for InmatesORDINANCE NO. 1320 v AN ORDINANCE OF THE CITY OF PORT ORCHARD ESTABLISHING CHARGES FOR INMATES WHO ARE INCARCERATED IN CERTAIN CELLS OF THE KITSAP COUNTY CORRECTIONAL FACILITY AND PROVIDING PENALTIES FOR PROVIDING FALSE INFORMATION IN APPLICATIONS FOR JAIL FEE CREDIT. THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES ORDAIN AS FOLLOWS: Section 1. The daily rate to be paid by inmates in the Special Detention Facility of the Kitsap County Correctional Facility shall be established as follows: ANNUAL INCOME DAILY FEE $ 15,000 $ 30.00 12,500 25.00 10,000 20.00 7.500 15.00 51000 10.00 2,500 5.00 -0- -0- Section 2. A credit shall be issued to each inmate who shows satisfactory proof that he or she: A. Has a maximum annual income, together with all persons in the household, below the poverty line as established by the Office of Management and Budget, Washington, D.C.; provided, however, that no credit shall be given to any person whose maximum annual income, together with all other persons in the household, exceeds $15,000.00; B. Does not have more than $5,000.00 of easily convertible assets and no member of his or her household has more than $5,000.00 of easily convertible assets. For purposes of determining this amount, any real property, excluding his/her current residence, is an easily convertible asset. All persons applying for the credit on their jail fees shall submit a completed and signed affidavit to the City of Port Orchard Treasurer's office on a form prepared by the Treasurer's office. They shall also submit a copy of their federal income tax return, together with copies of federal income tax returns of all other persons in the household, for the most recent tax year. Ordinance No. 1320 Page Two Section 3. Inmates qualified by the City Treasurer's office as eligible recipients of the credit provided herein shall be granted a twenty (20%) percent credit of their daily jail fee. In order to remain eligible for the credit provided herein, the incarcerated person must verify his/her income upon the commencement of each and every period of incarceration. Section 4. The willful provision of the City of Port Orchard of false information in application for a jail fee credit shall forfeit the citizen's eligibility for future credits and the citizen shall be required to repay the amount of the credit received based upon such false information. Section 5. Any person who willfully provides to the City of Port Orchard false information in an application for a jail fee credit is quilty of a misdemeanor and upon conviction shall be subject to up to $300.00 and/or ninety days in jail.
