ORDINANCE NO. 1268,/
AN ORDINANCE correcting clerical errors relating
to ULID No. 1 assessment amounts; amending Ordinance
No. 1237; and repealing Ordinance No. 1263.
WHEREAS, on June 23, 1983, a Special Committee of the City
Council (the "Special Committee") held a hearing for the purpose
of receiving objections and protests to the assessments and the
assessment roll for Utility Local Improvement District No. 1
("ULID No. 1"), and prior to such hearing the owners of the
properties listed at Exhibit A (attached and incorporated here
by reference) duly filed written objections to the assessment
roll; and
WHEREAS, based on the written objections filed by the
owners of the properties listed on Exhibit A, the Special
Committee recommended to the full City Council that the assess-
ments against those properties be adjusted in the amounts shown
on Exhibit A; and
WHEREAS, the City Council adopted the recommendations of
the Special Committee in full, but due to a clerical error the
adjustments shown on Exhibit A were not reflected on Exhibit A
to Ordinance No. 1237, passed July 25, 1983, which ordinance
modified, approved and confirmed the assessment roll; and
WHEREAS, on July 25, 1983, after due notice to the owners
of properties concerned, the Special Committee held a continua-
tion of its hearing on the ULID No. 1 assessment roll for the
purpose of receiving objections and protests from the owners of
certain properties, those owners not having received proper
notice of the June 23, 1983 hearing, and based on such July 25,
1983 continuation of its hearing, the Special Committee recom-
mended that such properties be assessed in the amounts shown on
Exhibit A to Ordinance No. 1237; such recommendation was adopted
by the City Council, but due to a clerical error the total
amount of the assessments against those properties were not
reflected in the total amount of the assessment roll as stated
In Section 2 of Ordinance No. 1237;
WHEREAS, the City Council sought to correct the clerical
errors described above by enactment of Ordinance No. 1263 passed
March 12, 1984, but Exhibit A to that ordinance itself contained
a clerical error by listing a reduction in assessment amount for
a parcel the assessment on which previously had been reduced to
zero;
WHEREAS, the assessment roll adopted by Ordinance No. 1237
twice included an assessment against a single parcel; and
WHEREAS, the City Council desires properly to correct the
clerical errors described above; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DO ORDAIN, as
follows:
Section 1. The assessments against the properties in ULID
No. 1 listed on Exhibit A (attached and incorporated here by
reference) are hereby adjusted and reduced in the manner shown
thereon.
Section 2. Section 2 of Ordinance No. 1237 is amended to
read as follows:
D� ed; Section 2. The assessments and assessment roll of
Utility Local Improvement District No. 1, which has been
created and established for the purpose of carrying out the
plan of additions to and betterments and extensions of the
waterworks utility of the City specified and adopted by
Ordinance No. 1220 of the City, as provided by Ordinance
No. 1231, as the same now stand after the modifications
made in Section 1 hereof, be and the same are in all things
and respects approved and confirmed in the total amount of
$6,370,021.58.

Section 3. Ordinance No. 1263, passed March 12, 1984, is
repealed.
Section 4. All actions of the City of Port Orchard, its
officers or employees heretofore taken in conformance with this
ordinance are hereby ratified and confirmed.
PASSED by the City Council at a regular open public meeting
thereof and APPROVED by the Mayor of the City of Port Orchard,
Washington, this 26th day of March, 1984.
