1227 - Ordinance - Amending Ordinance No. 1181 RE Housing AuthorityORDINANCE NO. 1227V AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING ORDINANCE NO. 1181 RELATIVE TO "HOUSING AUTHORITY" WHEREAS, the City of Port Orchard recognized the findings of the legislature contained in RCW 35.82.010; WHEREAS, the City of Port Orchard, in recognition of those findings and the need for a "Housing Authority", adopted and passed Ordinance No. 1181 on October 12, 1981; WHEREAS, a joint housing authority, the Bremerton- Kitsap County Housing Authority, was created and formed under said Ordinance and continues to exist, and yet the City of Bremerton has elected to terminate its participation in said joint housing authority; WHEREAS, in light of the withdrawal from the joint housing authority of the City of Bremerton the name of said housing authority requires redesignation and the governing board requires recomposition of its members; WHEREAS, the continued existence and operation of said joint housing authority, as previously established, is recognized as appropriate and necessary to meet and fill the need for a "Housing Authority", despite the withdrawal by the City of Bremerton; NOW, THEREFORE, BE IT ORDAINED by the Port Orchard City Council that Ordinance No. 1181 adopted on October 12, 1981 is hereby amended with respect to Section 1, 4, 5(c) and 8 to read as follows: "Section 1. Title. A joint housing authority by and between Kitsap County, the City of Port Orchard, the City of Poulsbo and the City of Winslow is hereby created under the title of the "Kitsap County Housing Authority". "Section 4. Appointment and Tenure of Commissioners. The Kitsap County Consolidated Housing Authority shall be governed by a board of six (6) commissioners composed of the elected members of the Board of County Commissioners of Kitsap County, the Mayor of Port Orchard, the Mayor of Poulsbo, and the Mayor of Winslow. (a) Appointment to the Board of Commissioners of the Kitsap County Consolidated Housing Authority shall take effect upon election and confirmation of office as a county or municipal official. A certificate of appointment or re -appointment to the Board of Commissioners of the Kitsap County Consolidated Housing Authority shall be filed with the Clerk of said Board and such certificate shall be conclusive evidence of the due and proper appointment of such commissioner. (b) Each commissioner shall hold office during his/ her tenure as an elected official of the county or municipality respectively and he/she shall continue to hold office until his/her successor has been appointed"; M 13&3 Section 5 "(c) Quorum. Four (4) members of the Board of Commissioners of the Kitsap County Consolidated Housing Authority shall constitute a quorum for the purpose of conducting its business and excercising its power for all other purposes."; "Section 8. Assumption of Assets and Liabilities of Existing Authority. The Kitsap County Consolidated Housing upon the effective date of this ordinance as first enacted assumes all assets and liabilities heretofore held by the Kitsap County Housing Authority.'; AND IT IS FURTHER ORDAINED that Ordinance No. 1181 adopted on October 12, 1981, is further amended so as to delete any and all references to the "Bremerton-Kitsap County Housing Authority", and to replace all such deleted reference with the name "Kitsap County Consolidated Housing Authority"; AND IT IS FURTHER ORDAINED that Ordinance No. 1181 adopted on October 12, 1981 is further amended so as to delete any and all references to the City of Bremerton or to the Commissioners or Board of Commissioners of the City of Bremerton; AND IT IS FURTHER ORDAINED that Ordinance No. 1181 adoped on October 12, 1981, except as amended above, shall remain and continue in full force and effect.
