1237 - Ordinance - Assessment roll of Utility Local Improvement District No. 1CITY OF PORT ORCHARD, WASHINGTON 1237 ORDINANCE NO. AN ORDINANCE modifying, approving and confirming the assessments and assessment roll of Utility Local Improvement District No. 1, which has been created and established for the purpose of carrying out the plan of additions to and betterments and extensions of the waterworks utility of the City specified and adopted by Ordinance No. 1220 of the City, as pro- vided by Ordinance No. 1231 and levying and assessing a part of the cost and expense thereof against the several lots, tracts, parcels of land and other prop- erty shown on the roll. WHEREAS, the assessment roll levying the special assess -- meats against properties located in Utility Local Improvement: District No. 1 in the City of Port Orchard, Washington (the "City"), has been filed with the City Treasurer as provided by law; and WHEREAS, notice of the time and place of hearing thereon and making objections and protests to the roll was duly pub- lished at and for the time and in the manner provided by law fixing the time and place of hearing thereon for the 23rd day of June, 1983, at the hour of 7:30 p.m., local time, at Cedar Heights Jr. High school, Port Orchard, Washington, before a Special Committee of the City Council (the 'Committee") and further notice thereof was duly mailed by the City Clerk to each property owner shown on the roll; and WHEREAS, at the time and place fixed and designated in the notice the hearing was held, written protests were considered and it was determined that the appraiser appointed by the Committee had not examined all of the parcels of property owned by persons filing written protests; and WHEREAS, the Committee was unable to hear all persons wishing to be heard at such hearing; and WHEREAS, the Committee determined to continue the hearing and ordered the appraiser to examine all parcels of property owned by persons filing written protests and to report to thy! Committee at the continued hearing and set the continued hearing for July 6, 1983, at 3:00 p.m. at the Port Orchard Active Club Building. Fort Orchard, Washington, at which time the Committee would hear those persons wishing to be heard and not heard at: the June 23, 1983, hearing, and would receive the report of the appraiser as aforesaid; and WHEREAS, on July 6. 1983. the continued hearing was recon- vened and the report of the appraiser was received, all written protests were considered and all persons wishing to be heard were heard, and the Committee determined that certain modifica- tions of the assessments appearing on the assessment roll should be made, and then continued the hearing until July 25, 1983. at the City Council Chambers, Port Orchard, Washington, for the purpose of receiving and considering written protests from certain property owners shown on the roll who had not received proper notice; and WHEREAS, the July 25, 1983, the continued hearing was reconvened, all written protests were considered and all per€aons wishing to be heard were heard, and the Committee determined to recommend to the City Council certain modifications to the assessment roil, and WHEREAS, the City Council received the report of its Committee, and, on July 25, 1983, sitting and acting as a Board of Equalization for the purpose of considering the roll and the special benefits to be received by each lot, parcel and tract of land shown upon such roll, determined to accept the report of the Committee and to modify certain of the assessments appearing on such roll and overruled all other protests; and - 2 - WHEREAS, after considering alternative methods of assess- ment, the City Council has determined that the method used to compute assessments, and the assessment roll itself, fairly reflect the special benefits to the properties to be assessed; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD. WASHINGTON. DO ORDAIN as follows: Section 1. The modifications as set forth in Exhibit A attached hereto and incorporated herein by this reference are made on the assessment roll of Utility Local Improvement District No. 1, Section 2. The assessments and assessment roll of Utility Local Improvement District No. 1. which has been created and established for the purpose of carrying out the plan of addi- tions to and betterments and extensions of the waterworks utility of the City specified and adopted by Ordinance No. 1220 of the City, as provided by Ordinance No. 1231, as the same now stand after the modifications made in Section l hereof, be and the same are in all things and respects approved and confirmed in the total amount of $6,368,640.92. Section 3. Each of the lots, tracts, parcels of land and other property shown upon the roll is determined and declared to be specially benefited by this improvement in at least the amount charged against the same. and the assessment appearing against the same is in proportion to the several assessments appearing upon the roll. There is levied and assessed against each lot, tract, parcel of land and other property appearing upon the roll the amount finally charged against the same thereon. Section 4. The assessment roll as modified, approved and confirmed shall be filed with the city Treasurer for collection and the Treasurer is authorized and directed to publish notice µ 3 as required by law stating that the roll is in her hands for collection and payment of any assessment thereon or any portion of the assessment can be made at any time within thirty days from the date of the first publication of such notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in 20 equal annual installments with interest thereon estimated to be 10% per annum with the exact interest rate to be fixed in the ordinance authorizing the issuance and sale of water and sewer revenue bonds to be supported in part by assessments levied in Utility Local Improvement District No. 1. The first installment of assessments on the assessment roll shall become due and payable during the thirty --day period suc- ceeding the date one year after the date of .first publication by the City Treasurer of notice that the assessment roll is in her hands for collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessments remains unpaid after the thirty -day period, interest upon the whole unpaid sum shall be charged at the rate as determined above, and each year there- after one of the installments, together with interest due on the unpaid balance, shall be collected. Any installment not paid prior to the expiration of the thirty -day period during which. such Installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at the rate specified above and for an addi- tional charge of 10% penalty levied upon both principal and interest due upon such installment or installments. The collec- tion of such delinquent installments will be enforced in the manner provided by law. - 4 - PASSED by the City Council and APPROVED by the Mayor of the City of Port orchard.
