1241 - Ordinance - POMC Chapter 10 Vehicles and TrafficORDINANCE NO. 1241'/ AN ORDINANCE ADDING A NEW SECTION TO TITLE 10 OF MUNICIPAL CODE, TRAFFIC" THE PORT ORCHARD "VEHICLES AND THE CITY OF PORT ORCHARD DOES ORDAIN: Section 1. That a new section be added to Title 10 of the Port Orchard Municipal Code which reads as follows: UNLAWFUL OPERATION OF MOTOR VEHICLE BY HABITUAL OFFENDER - PENALTY. It shall be unlawful for any person to operate a motor vehicle in this city while the order of revo- cation remains in effect. Any person found to be an habitual offender under the provisions of RCW Chapter 46.65, the Washington Habitual Traffic Offenders Act, who is thereafter convicted of operating a motor vehicle in this city while the order of revo- cation prohibiting such operation is in effect shall be guilty of a misdemeanor. Provided, That any person who is convicted for the offense of operating a motor vehicle while under the influence of intoxicating liquor or drugs as defined in RCW 46.61.502, (Port Orchard Municipal Code 10.04.010), or the offense of failure to stop and give information or render aid as required in RCW 46.52.020, (Port Orchard Municipal Code 10.04.010), and is also convicted of operating a motor vehicle while the order of revocation is in effect, shall be confined in the jail for not less than thirty days nor more than six months, and such sentence shall not be suspended or deferred.
