1176 - Ordinance - Designating Holidays within the CityORDINANCE NO. 1176V"� AN ORDINANCE OF THE CITY OF.PORT ORCHARD by WASHINGTOR ORDINANCE AMENDING ORDINANCE N0. 873, ORDINANCE N0. 481, ORDINANCE N0. 748 AND ORDINANCE NO. 715 (Port Orchard Municipal Hui — V81 Code Chapter 2.28) DESIGNATING HOLIDAYS WITHIN THE CITY OF PORT ORCHARD THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DO ORDAIN AS FOLLOWS: SECTION 1. That Section 1 of Ordinance No. 981; Section 3 of Ordinance No. 873; Section 1 of Ordinance No. 748 and Section 1, (G,H) of Ordinance No. 715 (Port Orchard Municipal Code Section 2.28.040) is hereby amended to read as follows: 2.28.040. (a) All full-time and part-time employees shall be entitled to observe the following holidays with pay: the first day of January, commonly called New Year's Day; the third Monday of February being celebrated as the anniversary of the birth of George Washington; the last Monday of May, commonly known as Memorial Day; the fourth day of July, being the anniversary of the Declaration of Independence; the first Monday in September, commonly known as Labor Day; the eleventh day of November, to be known as Veterans Day; the fourth Thursday in November, to be known as Thanksgiving; the day following Thanksgiving Day; the twenty-fifth day of December, commonly called Christmas Day and two personal holidays each year to be selected by the employee; provided: (1) The employee has been or is scheduled to be continuously employed by the City for more than four months, and (2) The employee has given not less than fourteen calendar days written notice to the supervisor; provided, however, the employee and the supervisor may agree upon an earlier date, and (3) The number of employees selecting a particular day off does not prevent an agency from providing continued public service. The personal holidays must be taken during the calendar year or entitlement to those days will lapse, except when the employee has requested a personal holiday and the request has been denied. (b) Anything in this chapter notwithstanding, any employee whose regular workweek includes a holiday or Saturday or Sunday will receive some other day off in lieu thereof at the discretion of the department head. (c) Whenever any legal holiday other than Sunday falls upon a Sunday, the following Monday shall be a legal holiday. (d) Whenever a legal holiday falls on Saturday, another day will be designated by executive order of the mayor, or he may designate two days, with a portion of the employees observing one day and the remainder the other day, to permit continued operation of vital functions.
